You get to decide...
You would think that when you pay for an escrow and the title fees you would be the one to decide who provides the service. It took a new state law to force the banks to go along. Most parties to a transaction aren't aware of this. So, even though it is a year old, I thought I would pass it along.

SB458
Recently a revised short sale bill passed the California Senate. SB 458. The most important detail is the added protection from 2nd mortgages, known as subordinate liens. In addition, now lenders can't require the seller to contribute cash to the deal. Of course, the lender can always chose a foreclosure and go after everything if is is a recourse loan. The reality is that almost all lenders are not doing this as they would have to go the Judicial foreclosure route.Follow the link for a full text. |
