Legislative Update

The Governor has signed S.4530-B (Saland)/A.6875-B (Lentol) as Chapter 342 of the Laws of 2011. This bill is intended to help limit the unrestricted flow of information subpoenas to community banks and credit unions. It was supported by IBANYS.

 

The bill amends General Business Law section 601 to require that where a principal creditor to whom a consumer claim is owed or their agent sends more than fifty information subpoenas per month, the principal creditor or their agent must maintain complete records concerning all information subpoenas sent by the principal creditor or their agent. The records shall include the grounds for such principal creditor or agent's reasonable belief. A failure to maintain the records is subject to a penalty of not more than fifty dollars per subpoena up to a maximum of five thousand dollars per violation. It provides for enforcement by the Attorney General. An aggrieved person served with more than fifty information subpoenas per month by a principal creditor or their agent is also provided a cause of action to enforce compliance with recordkeeping or compliance with the certification requirements for the information subpoena. A ten dollar fee is awarded for each information subpoena served without certification or where records were not maintained. Court costs and attorney fees are also available to a successful plaintiff.

 

The following bills were delivered to the Governor for action on Friday.

  •    Home Office Protection for One Bank Holding Companies (A.8157 (Abbate)/S.5004 (Griffo)
  •     Banking Development District extender for thrifts (S.5478 (Griffo)/A.8103-A (Meng)

Govt.-Backed Securities Unaffected by Downgrade

According to ICBA reports, Federal banking agencies have announced that despite Standard & Poor's downgrade of the federal government's long-term credit rating, risk weights for Treasury and other securities guaranteed by the U.S. government, government agencies or government-sponsored enterprises will stay the same.

The guidance applies to other securities under other federal banking agency regulations, including, the Federal Reserve Board's Regulation W. On Friday, Standard & Poor's lowered the rating from AAA to AA+.

IBANYS Remembers Hugh Carey    

  Hugh Carey, New York's governor from 1975-1982, died August 7th at the age of 92. Carey is most remembered for his work in keeping New York City away from bankruptcy during the fiscal crisis of 1975. Governor Andrew Cuomo hailed Carey  as a "true American success story."  

 

  In a 2007 interview with the New York Times, Carey said he would like to be remembered as "a man who loved the people of New York as much as he loved his own family."

Feds to hold rates through 2013 

 The Federal Open Market Committee has agreed to keep targets for the federal funds rate between 0 and 1/4 percent. The group believes this will promote ongoing economic recovery and hopefully keep inflation in check. They believe such a plan is required through at least mid-2013, given the current economy. The Committee also plans to continue reinvesting principal payments from its securities holdings. Their plan involves regularly reviewing said holdings in order to adjust as neccessary.
