Flygare & Associates and Las Vegas...

Recently I have had the opportunity to travel to Las Vegas and catch a show or two on "The Strip."  They were utterly fantastic but they got me thinking about coordination, being reliable, being on time at the right place, and most importantly getting the job done...in other words, "a standard of excellence."
 
As I sat in the audience watching the Cirque du Soleil production of "O," I suddenly realized that their show was in a sense what Flygare & Associates provides as a court reporting agency.

In The Zone
 

Have you ever wondered what the phrase "In The Zone" stands for?  In today's world we use this phrase in all aspects of our lives. 
 
Mih�ly Cs�kszentmih�lyi, was a Hungarian psychology professor born in 1934 and he immigrated to the United State in the 1950's.  He is known for his work in the areas of happiness and creativity but is best known for his concept of Flow.  Flow is the mental state of operation in which a person engaged in an activity is fully immersed in a feeling of energized focus, full involvement and success in the process of the activity.

  
According to Cs�kszentmih�lyi, flow is completely focused motivation.  It is a single-minded immersion and represents perhaps the ultimate in harnessing the emotions in the service of performing and learning.  In Flow, the emotions are not just contained and channeled, but positive, energized, and aligned with the task at hand.

Colloquial terms for this or similar mental states include: "To Be On The Ball", "In The Zone", "In The Groove", or "Keeping Your Head In The Game."

This flow and being "In The Zone" is a big part of my function in the transcription world.  When I'm working on a transcript I get into what I call my "Typing Zone Mojo" where I am so focused on getting your transcripts as accurate as possible and completed by the designated due date I forget about everything else going on in the office around me.  My "Typing Zone Mojo" is your guarantee that your transcripts will be the best product I can possibly give you.

In the ongoing video vault sagas, we continue to share different uses of video in the legal community.  This month I will provide some of my experiences with "Independent Medical Examinations," otherwise referred to as IMEs.
 
Flygare & Associates has been asked to record IMEs over the years for parties to litigation and we have certainly had objections from opposing sides from time to time regarding our presence in the exam room to video the medical examination process but as is the typical case the parties work toward an agreement of how they are to take place.
 
It is not the easiest thing for the videographer to do, "not say a word, not be in the doctor's, or in the patient's way during the exam," and these rooms are not always the biggest and most roomy areas to operate a camera and blend in so to speak.
 
Over the years, our video recordings have resulted in the ordering party being justified that we were there and there have also been a number of instances afterwards where the IME doctor thanked me for being there and recording what just took place.  We were able to verify via video that the doctor truly did what his report said he did.
 
In one situation, the attorney called right after the exam, before he even saw the tape, and said that the other side called to try and settle their matter without any further litigation because the patient was obviously malingering and trying to fake out not only the doctor but the insurance carrier as well.
 
Needless to say, the video IME is a very strong tool to use as it is a very accurate record of the exam.

The Supreme Court  has started accepting some documents in an electronic *PDF format.  
(*Portable Document Format (PDF) is a file format proprietary to Adobe Systems).  
 
"Electronic versions of all briefs on the merits must be in text searchable portable document format (PDF) compatible with the latest version of Adobe Acrobat with all fonts embedded. Documents must be directly converted from the word-processing format into PDF so as to preserve their search ability." (Click here to read this document in its entirety
 
Paper transcripts may soon be a thing of the past.  I know in our office between the proofing copy, the original, a copy (sometimes multiple copies) multiplied by the number of pages per transcript it can really add up.  The sheer number of sheets of paper can be huge.   
 
Benefits of electronic documents:
  • Green ~ Electronic documents will save on paper and paper waste. 
  • Cost Effective ~ Paper purchases, delivery and storage of documents can be quite expensive. 
  • Easy to share ~ Legal documents can be sent in a blink of an eye by email or made available online for instant access. 
  • Traceable ~ Easy to document email delivery or downloads with date, time and even identity stamps. 
  • Easy access ~ Documents can be accessed by laptop,  smart phone or a number of other file readers virtually anywhere without having to lug huge paper files around with you.
  • Searchable ~ Electronic documents are easy to search for specific words or phrases making it easy to locate specific items in the file without having to manually read through the whole thing. 
  • Storage ~ Huge files that would take box after box to store can be kept in virtual space, on CD's, thumbdrive or even stored right on a smart phone.  (Note:  remember to keep backups of your files in different physical as well as virtual locations.) 
 
Drawbacks of electronic documents: 
  • Some form of "reader" necessary ~ There are several forms of Readers available i.e. computer, kindle2, ipod, smartphone and ipad all have the ability to view PDF files (check with your phone provider to see if your smartphone or other reader is equipped with PDF reader applications).  
  • Limitations of "readers" ~ Can't read if you run out of battery power or in the bathtub or in a hot tub or on the beach or...
  • Minimal technical knowledge necessary ~ While using word processing software and opening files such as PDF's is fairly easy you do have to have some level of knowledge.  If you are reading this newsletter you probably already possess the knowledge necessary.
  • Software necessary ~ The format that is beginning to be accepted is PDF and must be created directly from your word processor to Adobe Acrobat to ensure that the format is correct.  In other words you can't use some of the free PDF creator programs.

As the Supreme Court goes, all other courts will probably soon follow.  Be ready for the future.  And remember that if your office is not quite ready to handle the technological rules of the court for direct conversion let Flygare and Associates be your virtual office assistant.
