More Than Meets The Eye

The Law Institute Journal (Nov 2007) recently published an article entitled 'More than meets the eye' which discussed the implications of Jarra Creek Central Packing Shed Pty Ltd v Amcor Limited (Jarra Creek) case to the discovery of electronic documents and metadata.  In this case, the judge stated that 'embedded electronic information in relevant documents, including electronic metadata, is discoverable under existing Federal Court Rules'.
 
Metadata (data about data) can be stored within a document, the local computer operating system or on remote servers.  The discovery of electronic documents and metadata involves the discovery of documents in their original or native format.  However, printing out an electronic document does not capture the native document in its entirety.  This article also points out the 'volatility' of  electronic documents and the importance of 'capturing and preserving these documents in a secure and verifiable way'.
