at MCCV's January 16 Meeting

A number of environmental policy initiatives emerged from the last California legislative session, many of which became effective the first of the year and will impact MCCV member companies.

To help its member companies better prepare and respond, MCCV has invited Gary Lucks JD, CPEA , a principal environmental attorney and scientist with Beyond Compliance to provide a compliance update at the Wednesday, Jan 16, 2008 MCCV Meeting. The presentation is scheduled for 8:30 to 9:30 a.m (the meeting will continue until 11:30 a.m.) No pre-registration is required.

The legislative and regulatory update covers new state and federal environmental legislation as well as relevant regulatory developments.  It will also reveals some important compliance implications for commercial and industrial organizations as well as state and local government entities.

 Lucks serves as a regulatory compliance and sustainability specialist where he advises clients on multi-media environmental audits, environmental permitting, training, and regulatory analysis, and multimedia environmental management systems (EMS).  Mr. He serves on the California State Bar Environmental Legislation Committee and has published numerous articles and .

 Beyond Compliance LLC bridges EH&S compliance counseling with sustainability principles.  Beyond Compliance is a consulting organization designed to help industry transition from a regulatory compliance model to one of sustainability where pollution prevention and concepts of sustainability improve performance and reduce the costs of doing business while exceeding command and control environmental compliance standards. 

MCCV schedules 2008 meetings: mark your calendar!
Mark your calendars for the third Wednesday of every month in 2008 from 8:30 to 11:30 a.m. for the MCCV's regular meetings which are open to all member companies and invited guests.
Regular agenda items include air, water, general regulatory and workforce issues, and most meetings feature a special presentation to provide members with pertinent information. Companies may send multiple representatives.

 Several changes have been made this year to help make this process easier for both employers and students and to ensure that the students local firms select for interviews have not already been hired! A new tracking system is in place to provide more reliable feedback and to help transition this into a year-round program. This year the program is expanding and will include 13-15 high schools in Modesto, Ceres, Patterson, Turlock, Oakdale and possibly Denair.

CSAT Top Screen Deadline Nears
Deadlines to submit the required on-line information and related documents pertaining to the Department of Homeland Security's Anti-Terrorism provisions for facilities which have threshold quanities of chemicals on hand are as follows.

Top Screen Submission Deadlines

  • Phase 1 & Phase 2 Facilities - January 22, 2008
  • Agricultural Production Facilities - To Be Determined (Read the Agricultural Extension Letter (PDF, 2 pages - 47 KB ))

Submission Deadlines for the Security Vulnerability Assessment tool (or DHS Form 9015) and the Site Security Plan have yet to be determined.

If a facility would like to request an extension, formal letters can be sent via regular mail to:

These deadlines were established with the publication of the final Chemicals of Interest list, Appendix A on November 20, 2007. With the publication of the final Appendix A, all provisions of 6 CFR Part 27 are now operative and in effect.

Overview

The Chemical Security Assessment Tool (CSAT) is the Department of Homeland Security's system for collecting and analyzing key data from chemical facilities to

  • register for CSAT, 
  • identify facilities that present a high level of risk, 
  • support the preliminary and final tiering decisions for individual high-risk facilities,
  • assess a facility's security vulnerabilities, and 
  • evaluate a facility's security plan to address vulnerabilities and meet risk-based performance standards.

. The Chemical Security Assessment Tool comprises four secure, web-based tools:

  • Facility Registration Questionnaire
  • Consequence screening questionnaire (Top-Screen);
  • Security Vulnerability Assessment (SVA) tool
  • Site Security Plan (SSP) template.

After registering for CSAT, facilities are provided access to the Top Screen, which enables the Department to determine if they are a high risk chemical facility covered by the Chemical Facility Anti-Terrorism Standards Interim Final Rule (CFATS).  For facilities that are determined to be high risk, other tools, specifically the SVA and SPP, are made available to satisfy additional CFATS requirements.
