MISREPRESENTATION DEFENSE ELIMINATED

Employers may no longer raise as a defense to a workers' compensation claim an employee's misrepresentation of his or her history of work-related injuries prior to being hired. The Supreme Court's ruling in Bassinger v Nebraska Heart Hospital[1] overturned the misrepresentation defense originally recognized by the Court in Hilt Truck Lines, Inc. v Jones[2]. New Law Affects Court-Approved Settlements with Minors in Nebraska

This law law imposes new requirements upon persons seeking to be appointed as guardians and/or conservators in the state of Nebraska and implements new reporting requirements upon those already serving in these roles. New W-2 Health Benefits Reporting Requirements

The Affordable Care Act, a federal law, requires employers to report the cost of coverage under an employer-sponsored Group Health Plan (GHP) on each employee's W-2. The mandatory reporting has been delayed to allow for time to update payroll systems, and will now be required of the employers subject to the requirement in the 2012 calendar year, to be reported on W-2 forms issued in 2013.
