Weber v. Gas 'N Shop: Further lessons on modification of Awards

In July 2010, we presented an article on the dangers of discontinuing temporary indemnity benefits without filing an application to modify a prior award. In the case of Daugherty v. County of Douglas, the Court of Appeals determined that the County of Douglas acted inappropriately in discontinuing temporary benefits that had been granted by a December 17, 2004 award during periods when the employee returned to his full-time work as a police officer receiving full wages. PLANNING FOR EMPLOYEE "BETRAYAL"

A frequent problem presented by employers is ex-employees leaving with confidential information or otherwise leaving to compete with them.   The issue comes up now because in an economy that produces or threatens layoffs, employees are doing what they can to protect themselves. They may forge a better deal with a competitor or a terminated employee may feel like the only choice is self-employment.
