Opportunities for Success in Nebraska Tort Cases

These famous words start out Charles Dickens' novel, "A Tale of Two Cities."  Defendants and their attorneys could say the same about two recent opinions of the Nebraska Supreme Court which, on the one hand, seemed to turn on its head how we analyze duty and the elements of a negligence cause of action, and on the other, declared that the opportunity to dispose of meritless claims at the summary judgment phase may yet remain unchanged.  The tale of these two cases has all the elements of any good story: setting, conflict and resolution.  Click here to read more.

New Program to Affect OSHA Procedures Regarding Work-Related Injuries and Illnesses in Nebraska

Employers should be aware that on February 22, 2011, the Nebraska Area Office of the Occupational Health and Safety Administration (OSHA) enacted a new Local Emphasis Program (LEP) for the purpose of reducing injuries and illnesses related to workplace exposures in private industry within the State of Nebraska. No Prejudice Needed to Deny Coverage for Late-Notice Under Claims-Made Policies

In a recent decision, the Nebraska Supreme Court considered the issue of whether an insurer must show prejudice before it may properly deny a claim for the reason that it received late notice under a claims-made insurance policy. Click here to read more.

Blake Featured on TransCanada Eminent Domain Issue

Bill Blake provided condemnation law commentary for a lead story featured by KOLN/KGIN TV News on April 17.  The news story dealt with the threat by the TransCanada Keystone Pipeline Company to acquire corridor easements for the planned XL Pipeline through condemnation proceedings before it has obtained the necessary permit to build the crude oil pipeline.  The permit must be obtained from the U.S. Department of State, but has been delayed due to environmental issues pertaining to the planned route through the Nebraska Sandhills.  TransCanada recently sent letters to landowners stating that the company hopes to receive the permit by the end of the year, and threatens to file condemnation proceedings if its latest offers to the landowners are not accepted within 30 days.
