Berntson Porter & Company is pleased to have assisted a group of business owners in analyzing and investigating a breach of contract and asset misappropriation matter. Our clients believed the fourth member of their ownership group breached their LLC Agreement and took money from the company. Allegations included taking excess distributions, paying vendors not related to the business, using employees for personal gain and loaning money to third parties without majority approval. The owners' legal counsel engaged us to testify as an expert witness for the client and to determine the damages the company suffered.
 
Result #1: We performed an analysis of the financial records and conducted interviews of the key employees. Our analysis determined the allegations were indeed correct and that the fourth member of the ownership group had breached their agreement. At the arbitration hearing, we provided expert testimony related to our findings and damages. Our clients were successful and were awarded over $200,000 in damages.
