The Recent Impact of the Patient Safety and Quality Improvement Act of 2005
 In 2005, the Federal Patient Safety and Quality Improvement Act (Public Law 109-41) became law. It provides certain safeguards for voluntary and confidential reporting of events resulting from medical care that adversely impact patients. Incardona v. Roer
In Incardona v. Roer, et al, plaintiffs specifically alleged "medical negligence" counts against the defendants, who were a nephrologist, a physician assistant, an interventional radiologist, and a kidney dialysis center. The plaintiff alleged that the defendants' failed to read the blood dialysis catheter package insert and communicate the instructions/warnings/precautions to the patient or another health care provider. read more

In Seda v. Maxim Healthcare Services, et al, the plaintiff alleged that a nurse employed by a healthcare service failed to monitor the deceased to ensure that his trachea tube was in place. read more
Economic Stimulus Package and Electronic Health Records
On Friday, February 13, 2009, Congress passed the American Recovery and Reinvestment Act of 2009 (the "Act"). This new economic stimulus package provides in excess of $19 billion to support and promote the adoption of Electronic Health Records ("EHR") for all Americans by 2014. read more
Recent Settlement Related to HIPAA Privacy Case
The U.S. Department of Health and Human Services ("HHS") and the Federal Trade Commission ("FTC") recently announced that CVS, the nations largest retail pharmacy chain, will pay 2.25 million dollars to the government for potential violations of the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") Privacy Rule. read more |
