District Court's Arbitration Program Celebrates its 20th Anniversary
On July 1, 2012, the Eighth Judicial District Court's Court Annexed Arbitration Program celebrates its 20th anniversary. The program is the result of the enactment of NRS 38.250, requiring that civil actions filed in district court for damages not exceeding a certain dollar amount (as of 2005, $50,000 per plaintiff) be submitted to nonbinding arbitration.
NRS 38.253 empowered the Nevada Supreme Court to adopt rules providing for the establishment of a court annexed arbitration program. Clark County's program became effective for all civil actions filed in district court on and after July 1, 1992; its first arbitrator was appointed on August 31, 1992.
ADR Commissioner Chris A. Beecroft, Jr., reports that through December 31, 2011, 71,903 arbitrators have been appointed and cases opened. He says that with the program enjoying an 80 percent rate of resolution, it is able to assist the District Court with keeping cases of lesser monetary value from clogging court dockets.
For more on the ADR programs' rules, forms, office policies and procedures, visit the court's website.
