Process Serving Plan A, Plan B, and Plan C

Imagine for a moment that you are a process server, and you have the task of serving legal papers. Where would you begin? Maybe you would locate the target's residence and attempt to serve them there. That's reasonable. We all live somewhere, and most of us spend a significant portion of our time at home, especially at the beginning and end of the day. If you successfully complete service at the residence, your job is done. Cross that one off the list.  


But what if you can't complete service at the target's residence? Personal service is universally understood as delivering the court documents directly to the intended party. What can you do if the target continually avoids you? What if the target lives in a gated community or a "doorman" apartment building? Can you simply post the papers on a door and consider that service? That depends on the target's resident jurisdiction and on what is called "the totality of circumstances." In the case of Greene v. Avoiding service is something process servers deal with all the time.  I am a firm believer that a person can only run and hide for so long before they get served.  


I have had to serve the same individual twice recently; each serve was at a different location, and neither was at his home. I completed the first serve with the help of the target's soon-to-be ex-wife and the client. The couple owned a lot of property, so the defendant could reside at any one of his numerous properties other than location listed to serve on the summons. Instead of going to every single home they owned, the client gave Aristocrat the defendant's wife's cell phone number. When I contacted her she provided vital details such as what car the defendant drives, where he would be the following day, when to expect him there, etc.  


Armed with her information I attempted service the next day. I waited 20-30 minutes for him to show up, and when he did, I pulled up to block his van and served him. I then called his wife and let her know that he had been served per the client's request.
