Whether you spend a lot or a little time in cyberspace, chances are your life is more electronic now than it was even a few years ago. From shopping and paying bills to banking and conducting business, many people are moving pieces of our lives online. With courts looking at new ways to serve legal papers, electronic service of process is also on the rise.


A few years ago attorneys in Australia, New Zealand, Canada, and the United Kingdom began using Facebook to serve legal notice. Joseph DeMarco, co-chair of the American Bar Association's criminal justice cyber-crime committee suggests that it is only a matter of time before the practice begins in the United States. DeMarco points out that once enough proof is gathered to convince a court that the holder of the social network account is the right person, and that the page is checked often enough to qualify it as a fair path of notification, "nothing on its face in New York state or federal law precludes it," adding that the process would have to occur without violating ethics codes that would prevent lawyers from "friending" the target in order to deliver the documents.1 has reported Tishman v. Like a lot of people, I use Facebook, Twitter, and other social media websites. I don't just use them to catch up with friends and family, though. I also use them to locate people in the course of my work. The evolution of the Internet has enabled people to create online personalities, or "cyber selves", and some people become so absorbed in their online communities that they seem to exist almost entirely online. Some of the subjects I attempt to serve no longer live at the address I have for them, or they do live at the address but don't want to answer the door to be served.  On numerous occasions, too many to count, I have successfully used the social media site Facebook to identify such a person's current residence or place of employment.
