What Is a "Sewer Serve"?
Children as young as five or six understand that sewers are for sanitation and storm water control and nothing else. And yet, many unethical process servers ignore this obvious fact. The practice known as a "sewer serve" is too common among disreputable process servers. In a "sewer serve" the process server literally dumps the papers in the sewer or discards them somewhere else, then claims they completed service. They even go so far as to file a phony affidavit attesting to service. The advantage for them is that they are paid without having to perform the often difficult work of completing service. The disadvantage for the intended subject is that having no notice of the process they fail to show up, and a judgment is made against them.

The Fair Debt Collection Practices Act (FDCPA) was enacted to "eliminate abusive practices in the collection of consumer debts, to promote fair debt collection, and to provide consumers with an avenue for disputing and obtaining validation of debt information in order to ensure the information's accuracy." Process Serving "True" Story  

 

"On Saturday January 8, 2011 the Seattle Seahawks and the New Orleans Saints matched wits in an NFL playoff game, and I matched wits with a prospective subject who did not want to be served." Thus begins a process serving True Story told by Kyle Evans, a server with Aristocrat Process Serving since 2004. Like the NFL athletes, Aristocrat process servers take their work very seriously. They train fully, they work hard, and they play fair... even when the "other team" doesn't.

We return now to Kyle Evans' story:

"When I arrived at the address I found the front door and living room blinds wide open. The subject was watching television in the living room (near the front door), but as I approached the door he retreated to the kitchen in the rear of the house, clearly attempting to avoid service. As I waited at the front door I could not see the subject, but I saw the football game on his television in the living room, and I realized that from his hiding spot in the kitchen the subject could not view the game.
