Improper Service is a Disservice to Your Case
You have probably heard the saying "Anything worth doing is worth doing well." We know attorneys who unfortunately learned a similar lesson the hard way: "Any document worth serving is worth serving correctly." Improper service is much more than an annoyance. It can delay obtainment of evidence, which can cause injunctions, court fees, and precious time and energy. In fact, service that violates Kansas law can cause your case to be delayed or dismissed entirely. It is in your best interest to hire a professional process server who is well-versed in the statutes of laws for service. It is a nominal investment with a significant pay off. However, you will be better able to serve your clients and prepare your case if you also have at least a fundamental understanding of Kansas law regarding service.

Somebody Here is Lying

 

I went to the door of a woman who identified herself as the individual who was to be served foreclosure papers. I informed this woman who I was, and that I was serving her with foreclosure papers. I presented her the proper papers, and she signed for them. This same woman later disputed service, and I was asked to go to court to identify her. While waiting for the hearing to begin, the woman walked in and sat down beside me. We exchanged pleasantries, and I immediately recognized her. When I was called to the stand and asked if the person I had served was in the courtroom, I pointed her out. During cross examination the opposing attorney asked how I could have served the woman at her residence considering she had been at work that day. When I reiterated that the woman in the courtroom was the person who had signed for the papers, she said "I didn't sign for nothing like this!" The Judge said, "Somebody here is lying, and I know who it is." He ordered the defendant to produce her time cards or work schedules within the next two weeks. A few weeks later Aristocrat Process Serving was notified that the defendant and another person at her place of employment had been terminated for lying about this. ~ Kenneth L Prewett
