REAC Clarifies Elevator Room Rules 
New Question and Answer Document Released
Effective January 4, 2010 the rule regarding inspections of elevator machine rooms went into effect, and REAC has released a Q&A guideline to help clarify this rule. The following is a summary of the clarification:

1.       If you WANT to have your elevator machine room inspected, you will have to either (a) have a licensed professional available during the inspection to accompany the inspector when entering the elevator machine room or have a written waiver that gives you (the Owner/Agent) permission to enter the elevator machine room.  

2.       If your elevator machine room provides access to other areas (e.g. you access the roof through the elevator room), the inspector will record all observed deficiencies that are not behind a permanent partition, fencing, or screen, located on a suitable balcony, gallery, or platform elevated and arranged as to exclude unqualified persons, or located at an elevation of 8 feet or more from the floor.

3.       Elevator machine rooms are inspectable if there are other components in the elevator machine room that are inspectable; the inspector determines if an elevator equipment room contains other inspectable items by asking the property owner or other on-site representative. If you do not believe that there are other components that are inspectable in the elevator equipment room, simply tell the inspector, and this room will not be inspected (assuming that the room does not provide access to other required areas).

4.       When the door to the elevator room is not locked during the inspection, it will be recorded as a health and safety deficiency.  Recorded under "Other" hazard which scores zero points.

If your property has an elevator machine or equipment room or rooms, you should determine if this room will need to be accessed during the course of the inspection. If you do need to go through the elevator room during the course of the inspection, you should make sure that you have a qualified person present or obtain a waiver from a qualified person giving you permission to provide access to the elevator machine room (we will creating a template and posting to our website shortly).

If you do not have any other inspectable items in the elevator machine room, it is our recommendation to develop a statement that you can include with your property's documents (rent roll, property measurements, etc) that states that the elevator machine rooms do not contain any other inspectable items. We will be creating a template for this statement as well and posting to our website shortly.
