QandAA commercial representative in a foreign country markets our company's products in exchange for a per unit sales commission. He also has asked for a monthly fee to be used to pay local officials in order to ensure that there are no adverse quality inspections. He assures you that these payments are necessary to "avoid problems" with local inspectors. He would make the payment for us, so that our company would not be directly involved. Should you pay him the monthly fee?

No. This type of payment is not appropriate. Furthermore, the fact that the request was made raises a "red flag" about the commercial representative's ethics and understanding of  FCPA requirements. You should contact your Legal Department or Chief Compliance Officer to report this situation promptly.
