Greetings!
2011 has passed and its time to look forward to building the future. I have made it through this holiday season and had the opportunity to reflect on the past year. Now, its time to move forward and hit the ground running. The New Year brings exciting adventures, new experiences, and new beginnings. As I begin my term as your President, it is my hope that we can all work together to make 2012 stand out from the rest. Our committees have already been working hard to make planning your year and your time easier and more effective by updating our Calendar of Events and planning CLE courses through the end of the year. It has always been my philosophy to not make resolutions but goals. Resolutions get lost sometimes, like junk mail, but goals never waiver and no matter how much time passes or how old you are these goals remain with you. Some of us have held on to certain goals for years until we were able to see them come to life. This is what I want for you, for our association, and our community. Set reasonable, attainable goals and hold on to them, make them come to life. I know that this will help each year become more and more successful. Now that we are into the New Year, I am so very excited that we are able to offer discounts to students and members who are interested in taking the computerized Certification Exam. We have our first testing sessions scheduled for the month of January at ITT Technical Institute in South Orlando. As you all know, membership renewals are now past due. If you did not take advantage of the early renewal period, please send your renewal application in no later than January 31, 2012 or your membership will be terminated. If your membership is terminated, you will have to complete a new membership application. If you have any questions, you can contact the membership chair at Membership@cfpainc.org. The Executive Committee, Committee Chairs, and the Board of Directors have all worked so hard behind the scenes over the past few months to help get us off to a running start in 2012. We have a great line up of CLE courses, including an Ethics Seminar scheduled for January 19th. If you need Ethics and you have not registered for this, please take the time to do so as Ethics are always hard to find. If you have not perused our website lately, take some time to do so. We are updating our events calendar to help you prepare for the year as we hope to see each of you more this year. We have some exciting things in store for 2012!

CFPA 2011 4th Quarter Charity Update ...
CFPA's 4th Quarter Charity for 2011 was the Harbor House of Central Florida. CFPA dedicated its Annual Meeting and Holiday Party to raising awareness and raising money for this great cause. Through raffle ticket sales and through a silent auction CFPA was able to donate approximately $2,000.00 to the Harbor House of Central Florida.

Testing sessions are FREE OF CHARGE to all CFPA members and legal studies students. Community Service Corner ...  It's 2012 and what a way to ring in the New Year and make the presence of CFPA known by coming out into our community this upcoming year. One of the goals mentioned at the annual meeting on December 2, 2011, was for more community service involvement. Our first opportunity for 2012 is CFPA for Second Harvest Service Days. If you are not familiar with Second Harvest it is a private, nonprofit organization whose mission is to fight hunger in Central Florida. Second Harvest relies on volunteers to make the difference they are aiming for. This email is to advise of a great volunteer opportunity we want our members to get involved in. It is a great way to meet and get to know one another while serving our community. We will be holding food drives through the year and more information as to drop off locations will be to come. The upcoming community service events will be for us to be Food Sorters at the Food Rescue Center located at 3533 Mercy Drive, Orlando, FL 32808. Family and friends are welcome to come volunteer too! However, volunteers need to be at least 10 years of age. This is a great opportunity for those students who need volunteer credit. Please let me know any students who will be volunteering ahead of time so I may ensure they receive proper credit. We will have two volunteer opportunities: Saturday, February 25, 2012 from 1:00PM to 4:00PM (20 volunteers needed) and Wednesday, March 21, 2012 from 6:00PM to 8:00PM (10 volunteers needed) So MARK YOUR CALENDAR and come on out for a few hours on either day or both days and make CFPA proud! Did You Know ...
Power of Attorney
Changes to Florida's Power of Attorney (PoA) laws went into effect on October 1, 2011. Please read CS/SB 670 for all of the changes and exceptions (e.g. powers granted by corporations).
A few changes will immediately impact real estate transactions in Florida. One change is that the Power of Attorney must be signed by the principal and two subscribing witnesses and be acknowledged by the principal before a notary. Previous Florida law required the power of attorney be executed with the same formalities as the document for which it were to be used. If a Power of Attorney were to be used for a deed, then two witnesses were required on the PoA because two witnesses are (still) required for deeds in Florida. If the power of attorney were to be used for a mortgage, then no witnesses were required on the PoA because no witnesses are required for a mortgage in Florida.
Now a Power of Attorney must have two witnesses and be notarized, regardless of the document type to be signed. There are a few exceptions, such as PoAs executed before October 1, 2011, PoAs properly executed in another state, and military powers of attorney that have their own rules.
Another recent change is that the authority granted must be specific. Powers of attorney that grant general powers (e.g. "all acts that the principal can do") are considered as not granting any authority at all.
And lastly I want to mention that "springing" powers of attorney are no longer viable. "Except as provided elsewhere, a power of attorney is ineffective if the power of attorney provides that it is to become effective at a future date or upon the occurrence of a future event or contingency." The exceptions are military powers of attorney and durable powers that were executed before October 1, 2011, but not exercisable before October 1, 2011 (i.e. the principal was not mentally incapacitated before that date).
If you are involved in creating, executing, implementing, or using powers of attorney for banking, health care, or real estate transactions, please read this law carefully.

As a Florida Registered Paralegal, you may be eligible for affiliate membership in some sections of The Florida Bar.
Affiliate section membership is voluntary and offers information and education in a specific area of law. Sections also provide opportunities to meet other FRPs within an area of practice. Affiliate membership in a section does not make you a member of The Florida Bar and you may not hold yourself out as a member of The Florida Bar. Depending on the section, you may be able to state that you are an affiliate member of the section.
