 NY State Legislation Update

Mercury thermostat take back legislation passes Senate

The Mercury Thermostat Take Back Bill S 4345B sponsored by Senator Mark Grisanti passed the NY Senate in June 56 to 4, after the Assembly bill (A 3485A) passed in  March. The legislative session closed before the two bills could be reconciled, but strong support for mercury take back legislation was shown by New York legislators. The NYPSC thanks Senator Grisanti, Assemblyman Robert Sweeney and Senate and Assembly co-sponsors for introducing this groundbreaking legislation, as well as the NY stakeholders who worked to improve the bill, and the NYPSC local government supporters who wrote or called their representatives. It's anticipated that the proposal will be reintroduced in both houses in the 2013 legislative session. Please mark your calendar for our December 5th webinar focused on this legislation.

EPR legislation covering a wide variety of materials, including compact fluorescent lamps, carpeting, paint, and smoke detectors has recently been introduced in the state legislature; the concept continues to develop support on both the Senate and Assembly sides, thanks in part to the efforts of NYPSC and its supporters. Protecting NY Waterways from Pharmaceutical Waste 

Concerned about pharmaceutical pollution in New York's waters? The NYPSC has partnered with the Product Stewardship Institute to create a centralized database to inform and gather perspectives on NY product stewardship solutions for pharmaceutical waste. NY stakeholders can be added to this pharmaceuticals database by sending an email to contact@nypsc.org with "Pharmaceuticals Stakeholder" in the subject field. Please include your organization and contact information. And please forward this invitation to your colleagues in organizations and agencies involved with water quality issues so they can be informed.

Alameda County, California Passes Nation's First Law Requiring Drug Companies to Manage Medication Disposal   

 With a unanimous 5-0 decision, Alameda County, California passed the nation's first  

local ordinance requiring pharmaceutical companies to finance the safe collection and management of pharmaceutical waste. The new legislation seeks to protect public health and the environment by helping to reduce prescription drug abuse, accidental poisonings and pollution of waterways. Proponents hope the ordinance will spur similar laws in other areas.  Read more about the Safe Drug Disposal Ordinance and support implementation progress of the new law by "liking" the Alameda County Safe Meds Facebook page.

 

Pharmaceutical Product Stewardship Bill
Introduced in Pennsylvania

A bill that would require prescription drug manufacturers to pay for and run collection events for unused medications was introduced into the Pennsylvania House. HB 2466  would require manufacturers to have at least one collection site for pharmaceuticals in each county in the state, with larger counties having additional sites. The program would not allow manufacturers to charge a fee at point-of-sale to finance collection. The bill was referred to the committee of health in June.    

 
U.S. EPA Reports on Hazardous Waste Pharmaceuticals

A recent EPA report examines the risk of potentially dangerous unregulated hazardous waste pharmaceuticals (HWPs) that may be unsafely disposed and released into the environment. 

Paint 

 Rhode Island Paint Bill Passed

A producer responsibility bill mandating the take back of leftover paint passed both chambers of the Rhode Island General Assembly and was signed by RI Governor Chaffee on June 27th. The bill was supported by the paint trade organization the American Coatings Association. The legislation will require paint stores to offer a paint drop-off service for unwanted oil-based and latex paints beginning in 2014.
 
California Paint Stewardship Program Plan
Will Launch in October

The plan for the California Paint Stewardship Program was approved on July 31, 2012 by the California Department of Resources Recycling and Recovery (CalRecycle). The new California law requires paint manufacturers to create and fund a convenient, cost-effective and environmentally responsible program to manage unused or leftover consumer paint PaintCare's California Paint Stewardship Program will launch in October 2012.  

Packaging 

 New Report Makes the Case for EPR Solutions for Packaging Packaging Report

A new report says that the U.S. is throwing away more than $11 billion each year in  post-consumer packaging that could be recycled. The report, Unfinished Business: The Case for Extended Producer Responsibility for Post-Consumer Packaging, was released in July 2012 by the nonprofit organization As You Sow.
