It seems just like yesterday when I joined the law  firm of Needham Mitnick & Pollack, plc (NMP) as "of counsel" after practicing law as a solo practitioner for 16 years.   Two years have actually passed since that time and I am delighted to announce that I have been named an official "Member" of the firm, also known as a Partner, effective, January 1, 2012.

All VETERANS WITH ALS ARE ELIGIBLE FOR SERVICE CONNECTED VETERANS BENEFITS

Since 2008, but not widely known, Veterans with amyotrophic lateral sclerosis (ALS) can receive badly-needed support for themselves and their families.

 

The U.S. Department of Veterans Affairs (VA) has published regulations granting military veterans diagnosed with amyotrophic lateral sclerosis, also called ALS or Lou Gehrig's Disease, full access to health and disability benefits. The rule covers all veterans serving at least 90 consecutive days no matter where or when they served.

 

Citing the high incidence of ALS among veterans who were diagnosed with the disease the VA designated ALS as a presumption of service connected disability and expanded benefits to all war veterans.

 

According to studies, military veterans within the last century are nearly twice as likely to develop ALS as those with no history of military service, regardless of where or when they served in the military.

NEW LAW REQUIRES COMMERCIAL POOLS TO BE ACCESSIBLE TO THE DISABLED

The federal government recently passed a law under the Americans with Disabilities Act (ADA) that requires commercial pool owners to make their pools accessible to persons with disabilities.  The new regulations apply to newly constructed commercial pools and existing structures, but not to residential pools.  Owners of existing pools have until April 2012  to bring their pools into compliance.

 

Under this new law, large pools with more than 300 linear feet of pool wall must have at least two accessible entryways. The primary entryway must be a pool lift that a person with a disability can independently operate or a sloped entry into the water.  The secondary entryway can be a lift, transfer wall or system, sloped entry or pool stairs. The two entryways provided should be different types and situated on different pool walls.  Pools with less than 300 linear feet of pool wall only require one accessible entryway that must be either a sloped entry or pool lift.
