Can Social Security Disability & SSI Benefits Be Garnished By Child Support Obligations?
|
Supplemental Security Insurance (SSI) benefits are not subject to garnishment by child support obligations. However Social Security Disability (SSDI) benefits are subject to garnishment by child support.
The amount that Social Security is allowed to garnish from a beneficiary's Social Security Disability benefit is the the lesser of:
------the maximum garnishment rate for the State where the beneficiary resides; or
------the maximum garnishment rate allowed by the Federal Government under the Consumer Credit Protection Act (CCPA) (15 U.S.C. 1673(b)). This CCPA limit is often referred to as the "Federal limit".
This "Federal limit" allows garnishment as follows:
A Social Security Disability Beneficiary's check can be garnished up to 50%, if the beneficiary is supporting another child in addition to the child whose support has been ordered. If the garnishment order or other evidence indicates the original support ordered is 12 or more weeks in arrears this amount increases to 55%.
A Social Security Disability Beneficiary's check can be garnished up to 60%, if the beneficiary is not supporting another child. If the garnishment order or other evidence indicates the original support ordered is 12 or more weeks in arrears this amount increases to 65%.

The Only Accessible Frank Lloyd Wright House To Become A Museum
|
Preservationists plan to open up the only fully-accessible house ever designed by architect Frank Lloyd Wright to the public as a museum.
The home, which features a fully-accessible layout and custom furnishings, is located in Rockford, Illinois. Frank Lloyd Wright was commissioned to build the house in 1949 by Kenneth Laurent, a World War II veteran who lost the use of his legs after a spinal cord injury during the war. In addition to an open floor plan and accessible switches, Wright included desks and other furniture to accommodate Kenneth Laurent's wheelchair. What's more, Wright designed the home so that its beauty could be best appreciated from a seated position. Mr. Laurent and his wife, Phyllis, have lived in the home since its completion in 1952, but are now moving to an assisted living facility. |
