DOT issued Final Rule:

Use of 2000 CCF extended through November 30, 2011

 

The Department of Transportation (DOT) has issued a final rule regarding the use of the Federal Drug Testing Custody and Control Form (CCF). The Final Rule now extends the deadline for the use of the 2000 CCF through November 30, 2011 and finalizes procedures for use of the new CCF.  Article Headline Chemicals Used to Create "Bath Salts" are Under Federal Control and Rugulation 
 

"The United States Drug Enforcement Administration (DEA) today exercised its emergency scheduling authority to control three synthetic stimulants (Mephedrone, 3,4 methylenedioxypyrovalerone (MDPV) and Methylone) used to make products marketed as "bath salts" and "plant food". Except as authorized by law, this action makes possessing and selling these chemicals, or the products that contain them, illegal in the United States." The DEA commented on the emergency scheduling stating, "this emergency action was necessary to prevent an imminent threat to the public safety. The temporary scheduling action will remain in effect for at least one year while the DEA and the United States Department of Health and Human Services (DHHS) further study whether these chemicals should be permanently controlled 

 

The chemicals will be under government control for a minimum of 12 months, with a possible six month extension. They are designated as Schedule I substances, "with a high potential for abuse, no currently accepted use for treatment in the United States and a lack of accepted safety for use of the drug under medical supervision." SAMSHA Releases Updated List of Certified Laboratories and IITFs 

 

The Department of Health and Human Services (HHS) notifies Federal agencies of the Laboratories and Instrumented Initial Testing Facilities (IITF) currently certified to meet the standards of the Mandatory Guidelines for Federal Workplace Drug Testing Programs (Mandatory Guidelines).

A notice listing all currently certified Laboratories and Instrumented Initial Testing Facilities (IITF) is published in the Federal Register during the first week of each month. If any Laboratory/IITF's certification is suspended or revoked, the Laboratory/IITF will be omitted from subsequent lists until such time as it is restored to full certification under the Mandatory Guidelines.


If any Laboratory/IITF has withdrawn from the HHS National Laboratory Certification Program (NLCP) during the past month, it will be listed at the end and will be omitted from the monthly listing thereafter.  To view the full notice, please click here DATIA eNews 10/6/2011

36 BOEING EMPLOYEES ARRESTED

FOR DISTRIBUTING OR PURCHASING

ILLEGAL PRESCRIPTION DRUGS

A long-term investigation by the Federal Bureau of Investigation (FBI) and the Drug

Enforcement Administration (DEA) has uncovered the widespread illegal transfer of prescription drugs at the Ridley Park, Pennsylvania Boeing Plant that produces U.S. military aircraft. The plant was raided on Thursday, September 29, 2011 and 37 people were arrested on charges of selling or buying prescription drugs. Most of the people arrested worked in the production area of the plant.

 

Of the 37 arrested, 36 were either current or former Boeing employees with one suspect being neither. Twenty-three suspects have already been indicted for illegally distributing

prescription drugs and for selling a controlled substance to an FBI cooperator. Fourteen defendants are being charged with a misdemeanor for purchasing a controlled substance from an FBI cooperator. The controlled substance was in fact a placebo.

 

The prescription drugs being distributed were fentanyl (Actiq - narcotic used to control

cancer pain), oxycodone (Oxycontin - is a narcotic pain reliever similar to morphine),

alprazolam (Xanax - used to treat anxiety and panic disorders) and buprenorphine (Suboxone - used to treat opiate addiction).

 

The raid comes after a four-year FBI and DEA investigation. The agencies were

informed of the illegal activity after an internal Boeing investigation. Boeing's investigation, which began in May 2006, started when concerned employees reported via an ethics hotline of suspected drug activity at the plant. Boeing shared its findings and suspects with the federal agencies in 2007.

National Survey Shows a Rise In Illicit Drug Use

The use of illicit drugs among Americans increased between 2008 and 2010 according to a national survey conducted by the Substance Abuse and Mental Health Services Administration (SAMHSA). The National Survey on Drug Use and Health (NSDUH) shows that 22.6 million Americans 12 or older (8.9-percent of the population) were current illicit drug users. The rate of use in 2010 was similar to the rate in 2009 (8.7-percent), but remained above the 2008 rate (8- percent).

 

An increased rate in the current use of marijuana seems to be one of the prime factors in the overall rise in illicit drug use. In 2010, 17.4 million Americans were current users of marijuana - compared to 14.4 million in 2007. This represents an increase in the rate of current marijuana use in the population 12 and older from 5.8 percent in 2007 to 6.9 percent in 2010.

 

Another disturbing trend is the continuing rise in the rate of current illicit drug use among young adults aged 18 to 25 from 19.6 percent in 2008 to 21.2 percent in 2009 and 21.5 percent in 2010. This increase was also driven in large part by a rise in the rate of current marijuana use among this population. Click here to read the full SAMHSA news release.

Quest Releases Drug Testing Index

Marijuana and Opiods Lead US Workforce Positives

 

Quest recently released its latest Drug Testing Index. The findings indicated hydrocodone and oxycodone are two of the leading drugs found in drug screens among the US general workforce. The only drug to outrank the two opioids is marijuana, which continues to have the highest positivity rating for workforce drug testing in the US. Compared to levels in 2005, oxycodone positives have increased by 96% and hydrocodone positives have increased by 47%. "The use and misuse of prescription opiates continue to capture national attention," stated Quest Diagnostics Director of Science and Technology for Employer Solutions, Dr. Barry Sample. "The findings of this study reinforce the need for businesses to develop and communicate clear policies around both the medical and non-medical use of these drugs, especially for their safety-sensitive workers. Empowering employees to perform duties safely, act appropriately when they perceive risk, and understand clearly the consequences of non-medical use of these drugs and of being found to have violated their employer's drug policy all play an important role in worker and public safety."
