NEW NPDES REGULATIONS MAY AFFECT YOUR PROJECT
On November 19, 2010, new Erosion Control and NPDES (National Pollutant Discharge Elimination System) regulations will take affect in Pennsylvania. There are numerous changes which will impact anyone planning to move dirt in the state. In addition to a dramatically expanded Erosion Control Manual and increased NPDES fees, there will be a significant change in requirements for projects disturbing between 1 and 5 acres of land. All sites in this category will now be required to obtain an NPDES permit prior to earth disturbance activities.
The new requirements will add cost to site improvement projects and time to the plan approval process. The approval time lines for NPDES permit plans are presented on the County Conservation District websites. The permit fees for a General NPDES permit will increase to $500 plus $100/acre disturbed in addition to whatever the County Conservation District review fee is. One of the many significant changes to the regulations is that there is a provision in the regulations requiring a licensed professional to perform inspections of certain stormwater management and sediment control items during construction.
The more stringent permit requirements will apply to new project submittals and projects with plan approval that are not under construction prior to November 19. This means that, even if you have final plan approval, you could face additional requirements, if you do not begin construction prior to November 19. Beginning on that date, the paperwork and plan requirements that currently apply to sites with over 5 acres of disturbance will apply to sites with between 1 and 5 acres of disturbance.
