SENATE BILL NO. 137

1 FOR AN ACT ENTITLED, An Act to require school districts and regental institutions to adopt

2 a policy prohibiting hazing.

3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

4 Section 1. The school board of each school district shall adopt a school district policy

5 prohibiting hazing. For purposes of this Act hazing is any activity by which any student

6 intentionally or recklessly endangers the physical or mental health or safety of any other student

7 for the purpose of initiation into, admission into, affiliation with, or continued membership with

8 any organization or group regardless of the other student's willingness to participate.

9 Section 2. Each institution of higher education shall adopt an institution policy prohibiting

10 hazing. For purposes of this Act, hazing is any activity by which any student intentionally or

11 recklessly endangers the physical or mental health or safety of any other student for the purpose

12 of initiation into, admission into, affiliation with, or continued membership with any

13 organization or group regardless of the other student's willingness to participate.
