YOUNG DEALERSHIP EMPLOYEES NOT PERMITTED TO PERFORM CERTAIN TASKS
Dealers often employ minors during the summer, during school breaks, after school and on weekends. While workers 18 years and older generally may perform any job, federal and state laws restrict the ability of dealerships to employ minors in certain "hazardous" occupations or to do certain "hazardous" jobs. For example, federal law constrains the ability of minors to operate vehicles on public roadways. See: L.1, NADA's Guide to the Fair Labor Standards and Equal Pay Acts.
Recently, the U.S. Department of Labor clarified its rules governing "child" labor:
▪ 14- and 15-year-olds may not be employed in occupations that involve operating, tending, setting up, adjusting, cleaning, oiling or repairing any power-driven machinery, including but not limited to lawn mowers, golf carts, ATVs, trimmers, cutters, weed-eaters, edgers, etc. On the other hand, they may operate office equipment and vacuum cleaners.
▪ 14- and 15-year-olds generally may ride inside motor vehicles but not on beds, running boards or bumpers, and not in conjunction with the transportation of persons or property (e.g., delivering parts). They generally may not load or unload motor vehicles, except for light non-power-driven hand tools (e.g., rakes, clippers, shovels or brooms) or personal items (e.g., back packs, lunch boxes and coats).
▪ 14 and 15-year-olds may work in connection with cars and trucks if confined to: dispensing gasoline and oil; courtesy service; car cleaning, washing and polishing by hand; but not if the work involves pits, racks or lifting apparatus, or the inflation of any tire mounted on a rim equipped with a removable retaining ring. Despite NADA's objections, cleaning, washing and polishing using any powered equipment is not permitted. PHONE RELAY/CREDIT CARD SCAM
There seems to be a resurgence of the telephone translation relay calls seeking automotive shops that will debit a credit card and send a portion of that payment back to the caller. This is all done under the guise of a mysterious "damaged" vehicle that has yet to be delivered to the shop. We have received several reports in the last two weeks of this all-too-familiar scam.
The new twist on this variation, however, is that it involves e-mail - very, very poorly written e-mail. Initial contact is made through the telephone, then the scammers attempt to complete their fraud through e-mail messaging. There is also an emotional appeal as the sender claims to be afflicted with a mortal disease and is in intensive care (not that anyone would wonder how an intensive care patient could generate all these messages).
The initial calls are persistent, with sometimes as many as four or five in a single day.

It is an inexpensive insurance policy. Defeating legislation that would eliminate dealership tax exemptions and fighting for the dealer exemption to the federal Wall Street reform law are two great examples of why we need to be strong politically. If you have not given yet to the PACs this year please do so at this time.

Basics workshops will be full day sessions which begin at 8:30 AM and will conclude at 4:30 PM. They will be held jointly with titles personnel from both financial agencies and dealerships. Beginner workshops will address title fundamentals, including the who's, what's, when's where's and how's of titling; an overview of the titles process; how to prepare title forms; the requirements for standard title transactions; sales tax basics; title brands; and, the most frequent errors committed by dealers and financial agencies and how to avoid them.
