BUREAU OF CONSUMER FINANCIAL PROTECTION (BCFP) AND THE OTHER SHOE
Franchised motor vehicle dealers are right to be proud of the work done to exempt themselves from the jurisdiction of the new Bureau of Consumer Financial Protection (BCFP) that will be created by the federal financial reform legislation. The exemption will be important in permitting dealers to work on behalf of consumers to help them find appropriate financing necessary for sales of vehicles. Winning the exemption required hard work by dealers, NADA, IADA, and many others. However, as with most matters involving Congress, there are other shoes that assuredly will drop.

DEPPARTMENT OF ENVIRONMENTAL QUALITY (DEQ)
AIR QUALITY PERMIT
Please note that if your facility does not apply coatings to automobiles please disregard this notice.
Recently, the DEQ undertook efforts to determine whether automotive coating facilities are required to obtain an air quality permit under current Idaho State law. After researching this issue, DEQ has determined that the majority of automotive coating facilities are operating without the required air permit. In order to help facilities get into compliance with permitting requirements and to make the permitting process more cost effective, consistent, and timely, DEQ has developed a "General Permit" for automotive coating facilities. This General Permit is intended to address the majority of automotive coating facilities. For facilities that cannot meet the General Permit requirements, an air quality permit can be "tailored" to individual facilities on a case-by-case basis. Automotive coating facilities that use a maximum of 1.3 gallons or less per day, every day of the year, for all coating materials, may be exempt from permit requirements.
Please be advised that your facility has until December 31, 2010 to submit either an application for a General Permit, tailored permit, or provide exemption documentation. Permit application and exemption forms and information are available on DEQ's website at www.deq.idaho.gov. See the section titled "Air", then "Permits and Forms", and finally the link titled "General Permit for Automotive Coating Operations". General permit applications require a one-time application fee of $1,500. Should you choose a tailored permit, fees will be based on IDAPA 58.01.01.225 (Rules for the Control of Air Pollution in Idaho) and will be more than $1500.00 depending on the size of the facility. No fees are required for exemptions.
Automotive coating facilities that have not submitted an application for a permit or exemption by December 31, 2010 may be subject to an enforcement review. Basics workshops will be full day sessions which begin at 8:30 AM and will conclude at 4:30 PM. They will be held jointly with titles personnel from both financial agencies and dealerships. Beginner workshops will address title fundamentals, including the who's, what's, when's where's and how's of titling; an overview of the titles process; how to prepare title forms; the requirements for standard title transactions; sales tax basics; title brands; and, the most frequent errors committed by dealers and financial agencies and how to avoid them.

Update workshops will be half day sessions, held exclusively for dealer personnel. Morning sessions will begin at 8:30 AM and will conclude at 12:00 PM, while afternoon sessions will begin at 1:30 PM and will conclude at 5:00 PM. Update workshops will focus primarily on title and sales tax law and policy changes that have occurred since 2008. A time will also be reserved to address requested topics. |
