MONUMENTAL FEDERAL-ISSUE VICTORY

 

Auto dealers have prevailed at remaining exempt from the reach of the proposed Consumer Financial Protection Bureau.   This monumental victory came largely against the odds and counter to powerful adversaries such as big banks, community bankers, credit unions, military and veteran groups and cranky consumer advocates.  Additionally, President Barack Obama strongly advocated to Members of Congress that auto dealers be included in the legislation.

 

The monetary value of this historic victory to consumers and to dealers is difficult to assess.  Clearly, dealers having been included in the reach of CFPB would have cost financing choices to millions of consumers resulting in much more costly auto financing and would have netted a measurable drop in the number of consumers able to obtain financing arrangements.  For dealers, compliance costs would have easily reached billions of dollars collectively across the country.  Being frozen out of auto financing would have cost each dealership as much as 10 to 20 percent of revenues, and arguably, much more.

NADA, and in particular NADA's Legislative staff, deserve a huge "thank you" for their months-long effort to exclude dealers from compliance oversight by the new CFPB.  The NADA Legislative Office is lead by David Regan and includes Ivette Rivera-Hays, Michael Harrington, Patrick Calpin, Joshua Heit, and Bailey Wood.

This is an enormous win for auto dealers, and what we actually accomplished through this effort is staggering.  We took on consumer groups, military family groups, the bureaucrats, and the large financial institutions and received virtually everything the dealers asked for. It's quite incredible when you think about it. 

 

I would like to say a "Special Thank You" to the dealers that have supported DEAC and Idaho AUTOPAC, without those dealers and the investment they have made through the years, this victory would not have been possible.  It truly was a victory of enormous size! I hope all dealers in the State of Idaho will consider making an investment in all of our futures by contributing to DEAC; it should be the first investment we make each year from our dealerships, as it is truly the only hope we have to protect the franchise system we all enjoy!

IS YOUR PHOTOCOPIER STEALING CUSTOMER DATA?

 

In a story that has shocked businesses nationwide, CBS recently reported on a massive information security concern which has caught even the most sophisticated businesses off guard: modern scanners and photocopiers contain hard drives storing digital images of tens of thousands of recent copies. That's right: when you photocopy something, you aren't just creating two paper copies, but also a third electronic copy of the document.

 

Dealers regularly scan driver's licenses, credit applications, credit reports, conditional sales or lease agreements, and several other documents containing sensitive consumer information. When your copier or scanner lease expires and the lessor picks up the equipment, they may not expunge the copier records before selling or leasing the equipment to another party. When somebody takes possession of your former copier, they may also be acquiring a goldmine of data for potential use in identity thefts.

 

Under state and federal law, you have responsibilities to safeguard nonpublic customer data, including the requirement that you develop a comprehensive safeguards program to protect such data, and that this plan be updated regularly when you learn of additional risks. With copier and scanner security risks making national news, it may be a good idea to update your safeguards program to address copier and scanner-related data security. This is all-the-more important since California law triggers additional requirements when electronically-stored personal information is breached-including mandatory reporting of the breach to affected consumers. In any event, when turning in a leased copier, confirm with the lessor whether the hard drive will be cleared by the vendor; if so, seek confirmation of this commitment in writing. If you are selling old equipment, or your lessor will not clear the hard drive, be sure to take steps to either do so yourself, or hire a vendor to do so on your behalf.
