2010 LEGISLATIVE SESSION
After a busy end game of debating and passing dozens of bills the Idaho legislature ended its 2010 legislative session on Monday. The debate is on with regards to future tax revenues and the possibility of a special session later this summer but after 79 days, and a balanced budget they are headed for home... for now.
IADA's service contract legislation has passed all the hurdles that was placed before it and is awaiting the governor's approval before becoming law on July 1 2010. S1357 has been a two year process aimed at amending the law pertaining to automotive service contracts. The bill will strengthen insurance requirements by requiring sufficient surplus by a financially solvent insurer so that persons purchasing from service contract providers will know that the provider is fiscally sound. In addition, the bill prohibits deceptive practices by service contract providers, and adds criminal and civil penalties of $1000 per day per violation and is enforceable by the county prosecutor or attorney general.
Also awaiting approval by the governor is the Dealer Advisory Boards legislation dealing with continuing education for initial dealer licenses. S1361 would create a new requirement that used auto dealers complete an eight hour CE course of instruction. IADA has supported S1361 from the beginning and will continue to work to raise the bar for dealers licensing in the state of Idaho.

Thank you to all who helped the IADA this year with our legislative goals. When asked, you called your representatives and senators setting in motion a strong grass roots effort from Idaho's auto industry leaders. Although we just finished the 2010 legislative session here in Boise there is no time to waste in preparing for 2011. IADA will be asking legislators to support its efforts to continue amending state law to further protect dealers from unfair requirements imposed by manufacturers and protect important sales tax exemptions on used vehicle trade in's and rebates.

IADA's AUTOPAC & DEAC FUNDRAISING CAMPAIGNS 2010
Through IADA's Political Action Committee, AUTOPAC IADA supports pro-business, pro-dealer legislative candidates. 2010 will be a critical election year. Those elected this last election cycle will have a huge impact on the way automobile dealers do business for the next 8 years.The current legislature will address franchise license law updates and filling a huge hole in the state budget (with the potential for increased taxes like a sales tax on consumer rebates and increased DMV fees). If we do not elect policy-makers who support automobile dealer issues, your livelihood is at risk.
In 2009, Idaho dealers contributed $11,350 to AUTOPAC to support state elected officials who are sympathetic to dealer concerns. This year's goal is $17,000. AUTOPAC is instrumental in realizing the Association's legislative agenda.
Contributions to NADA's Dealer Election Action Committee (DEAC) are also vital, as they help expand the automotive industry's voice in Congress. Dealers' donations are needed more than ever for both AUTOPAC and DEAC to ensure that Idaho dealers' interests are being represented to match the impact of their economic contributions to the state. A solicitation mailing outlining this year's fundraising campaign for both AUTOPAC and DEAC will be sent to dealers in the near future. RED FLAGS RULE REMINDER
IADA was recently advised by a large captive finance company that several of their dealer clients are refusing to implement the upcoming FTC Red Flags Rule (enforcement of which has been delayed an unprecedented four times, and which is set to begin June 1, 2010).
The dealers refusing to implement the law each gave one of two equally mistaken reasons:
Myth #1: The Red Flags Rule does not apply to new car dealers.
Myth Busted: The Red Flags Rule applies to "Creditors" and their "Covered Accounts." Creditors are defined to specifically include automobile dealers, and "Covered Accounts" specifically include automobile loans.
Myth #2: Compliance with the Red Flags Rule by a finance company "trickles down" to the dealership-requiring no further action by the dealership to comply.
Myth Busted: The duties under the Red Flags Rule specifically apply to all entities subject to the Red Flags Rule-including dealers. You are specifically required to create and implement a comprehensive Identity Theft Prevention Plan, as are the financial institutions with which you do business. Just as the Red Flags Rule requires that you ensure that auto brokers and other service providers implement policies and procedures to detect, prevent, and mitigate the risk of identity theft, these banks and credit unions will be required to ensure you do the same before doing business with you. In practical terms, banks and credit unions will contractually require your dealership to implement an identity theft prevention program as a condition of buying your contracts.
