SALES TAX LEGISLATION (S1295 AND S1381)
Yesterday afternoon at its 3 pm meeting the Senate Local Government and Taxation Committee heard two bills related to sales tax. We summarized S1295 in an earlier tax bulletin. This bill proposes that the State Tax Commission be allowed to participate in discussions with other states in the Streamlined Sales Tax Project (SSTP) with the goal of collecting sales/use tax from remote sales such as internet/mail order sales. The other bill is S1381 (much like legislation proposed in previous legislative sessions) providing that the legislature conduct a review of all sales tax exemptions during any 5 year period and that any sales tax exemptions enacted after July 1, 2010 shall expire five years after, unless extended by statute. The most recent interim legislative committees having done similar studies in 2003/2004 and again in 2007. We will keep you posted on S1381 and yet another potential interim study on this matter.
LOOKING AHEAD
Although some legislative proposals have already been introduced with the purpose of incenting Idaho job growth and economic development, the most recent was H597. This bill provides taxpayers a $2,000 tax credit per new employee who, in the calendar year ending during the taxable year for which the credit is claimed, received annual earnings at an average rate of $16.83 per hour ($35,000 annual) or more. And, who during such calendar year also received employer provided accident and health plan coverage described in Section 105 of the Internal Revenue Code. H597 is awaiting a hearing in the House Revenue and Taxation Committee.
We know there are other job creation/economic incentive proposals floating around. Depending on how many of those are introduced and their potential effectiveness will determine how vigilant legislative tax committees will be. Whatever surfaces next week we will be researching, highlighting and reporting.
In addition to our legislation there has been many other bills filed during the first two months of Session regarding texting while driving, workers compensation, automobile insurance, emission inspections, and sales tax exemptions. CREDIT CARD ACT: PROCESSING IMPACT
Last year the Credit Card Accountability Responsibility and Disclosure Act of 2009 (or the Credit CARD Act of 2009) was signed into law. This new law will affect how some transactions are handled at the point of sale. Specifically, as part of the new law, consumers who attempt to pay for transactions and hit their credit limit (credit cards effective Feb 22) or available DDA balance (debit/check cards effective July 1) will be declined at the point of sale unless they had requested a higher line of credit or had enrolled/opted in for overdraft protection when establishing an account. Since the practice by banks prior to this was often to extend "float," many consumers were accustomed to riding close to their limit/balance.

COBRA SUBSIDY DEADLINE -- FEBRUARY 28
On December 21, 2009, President Obama signed a measure to extend a federal subsidy for continued health-insurance coverage for involuntarily terminated workers under employer group plans until February 28, 2010.Therefore, an employee who was involuntarily terminated between September 1, 2008, and February 28, 2010, may be eligible for COBRA premium assistance. With the subsidy, terminated workers pay 35% of the premium. Employers are responsible for paying the additional 65% of the COBRA premium, which will ultimately be funded by the federal government through an offset of payroll taxes. COBRA eligible employees who are eligible for other group health coverage (such as a spouse's plan) or Medicare are not eligible for the premium reduction. Employees terminated after February 28, 2010, will also not be eligible for the federal subsidy. Employers who were involved in the COBRA subsidy will need to keep their records of the COBRA payments made for IRS reporting purposes.
TEXT MESSAGING: REGULATIONS FOR DEALER COMMUNICATIONS WITH CUSTOMERS
Communications with prospective customers or others via "text messaging" may be subject to a number of federal regulations. The legal landscape covering text messaging was crafted before such technology existed. A text message may be deemed to be a phone call, an email, or perhaps even both under federal law. IRS REQUIREMENTS FOR COMPUTERIZED ACCOUNTING RECORDS
The IRS has certain requirements concerning the retention of computerized accounting records. Computerized records include all accounting and financial systems that process all or part of the dealer's transactions, records, or data by other than manual methods. Systems include microcomputer systems, data base management systems (DBMS) and all systems using electronic data interchange. Punched cards, magnetic tapes, disks and other machine-sensible media used for recording, consolidating, and summarizing accounting transactions and records in a dealer's computer system are records for purposes of IRS recordkeeping requirements. The IRS requires that dealers maintain these records for as long as their contents may be material in administering any tax law. This requirement applies to any record covered by a tax provision having unique or specific recordkeeping requirements. Click Here to read the rest of this article.
EPA INITIAL NOTIFICATION FORM REQUIRED FOR BODY SHOPS BY JANUARY 11, 2010
The Environmental Protection Agency's (EPA) rule governing hazardous air pollutants (HAPs) requires existing body shops to file an "Initial Notification Form" by January 11, 2010.
