The Regular Session of the Idaho Legislature is in its 5th week. As many of you have read or seen on the news this year's legislative session is bogged down with budget scrutiny. What does this mean for the IADA and other trade groups that actively lobby at the capital?  It means that anything that doesn't have a positive fiscal impact to the state budget is not going further than the committee room.  As I mentioned in our last newsletter the IADA has plans to run several pieces of legislation this year dealing with service contract advertising, financial minimums for insurance companies backing service contracts and a new dealer laden plate for transporting vehicles using your new inventory.  Those pieces of legislation are still on track for full hearings but much more than that has little opportunity for the legislature's attention. 
 
This session is not already without big victories. The IADA is conjunction with the Idaho Retailers Association and the ISIADA successfully lobbied the state tax commission to shelve their idea to change the way retailers apply for prorated shares of the sales tax paid on delinquent of failed retail loans. This is a big win for the auto industry and the IADA has committed to working with the Sales Tax Commission to find a solution to this area that seems to be a burden for both the dealers and the tax commission administrators. 
 
In addition to our legislation there has been many other bills filed during the first month of Session regarding texting while driving, workers compensation, automobile insurance, emission inspections, and sales tax exemptions. A YEAR OF HIGHER SALES, NEW AND USED, IN 2010

If any doubters of the fact that recovery is firmly underway remain, note the advanced estimates for fourth quarter GDP growth of 5.7 percent indicated the momentum, which preceded the start of this new year. Our expectation is for 2010 growth of real GDP of at least 3 percent with stronger growth in the second half of the year. The fourth quarter 2009 result is good news because it provides momentum in the first half of this year when some of the government stimulus efforts and Fed assistance to the mortgage market will be reduced.

THE CASH FOR CLUNKERS SALES EFFORT

NADA recently published its January 2010 Economic Update, which included a wrap-up of the Cash for Clunkers sales effort.  Following are a few bullet points from that report.

Cash for Clunkers caused a large spike in new vehicle sales in July and August. The August SAAR was 14.1 million units.

 

Inventory at the end of 2009 was at a 53 day supply. There were a little less than 2/3rd's of 2008 new vehicle inventory levels at the end of November of 2009.

 

There was about half the level of inventory in August 2009 compared to the end of August 2008, at the end of the Cash for Clunkers incentives. That August supply translated into a very low rate of 29 days of new light vehicle supply.

 

Typical new car buyers don't drive 5 to 10 year old Clunkers; typical used car buyers drive Clunkers.  And the incentives offered by Cash for Clunkers converted many of them into new car purchasers.

 

As new car inventory came back, new car and truck sales improved in the last three months of 2009 compared with the first six months of 2009.

Regulatory Updates

EPA INITIAL NOTIFICATION FORM REQUIRED FOR BODY SHOPS BY JANUARY 11, 2010

The Environmental Protection Agency's (EPA) rule governing hazardous air pollutants (HAPs) requires existing body shops to file an "Initial Notification Form" by January 11, 2010.

LABOR LAW POSTERS

As a reminder, dealers should now be displaying the recently updated EEOC labor law poster, which includes changes mandated under the Genetic Information Nondiscrimination Act and the Americans With Disabilities Act.  All Labor Law Posters can be downloaded and printed free of cost at the Idaho State Department of Labor.  

HAZMAT CERTIFICATION

As a reminder, the U.S. Department of Transportation requires businesses that package, transport/ship, handle or store hazardous materials to have at least one DOT HazMat certified employee at the location during all hours of operation.  Hazardous materials referenced in these regulations include, flammable liquids, compressed gas cylinders, air bag modules, seat belt with pre-tensioners, paints, adhesives and hazardous waste.  Re-certification is required every three years. 

TREND SPOTTING
 
New car dealers should be pleased that the rampant telemarketing of expiring warranty scams is showing signs of winding down, thanks to the legal actions now being pursued in the courts by 50 attorney generals (CDI 1/1/2010) and the Federal Trade Commission, but also the solutions the market itself is imposing on those who abused their customers. On the one hand, thanks to the increased enforcement of "do-not-call" rules, the companies that called every phone number they could find are now curtailing those activities, letting some of their sales staff go, and finding other ways to sell their vehicle service contracts. On the other hand, the industry itself is making great progress in the realm of industry self-regulation, thanks to the efforts of trade groups such as the Vehicle Protection Association.

Seventeen months ago, there were perhaps 100 to 120 direct marketing companies in the business, many of them auto-dialing or mass-mailing their "expiring warranty" messages, until the regulators simply had enough. Many were litigated out of business, or had to close when the do-not-call and telemarketing rules became much more restrictive. Today there are perhaps only 40 companies left in the direct warranty marketing industry.
