Dealer Community Accomplishments

For the past several years Cole Chevrolet has had a Relay for Life team for the American Cancer Society.  This year the Pocatello teams raised over $121,000.  The Cole Chevrolet Team contributed over $1500 toward that effort.  The team had a couple of barbecues for employees and customers during the work week and sold city wide raffle tickets for a handmade hope chest designed and made by their Service Manager, Joe Osterman.  His wife Malia made purple and pink ribbon (breast cancer awareness) bags which were sold the evening of the event.  This is the third year Cole Chevrolet has had a team. 

Congratulations to Cole Chevrolet for making a difference in their community.

CARS ACT, AKA "CASH FOR CLUNKERS" -- LATEST NADA UPDATES:

NADA Update: NHTSA Loosens Requirements for 'Clunkers' Program (8/1/09)
 
Responding to numerous dealer concerns, the National Highway Traffic Safety Administration last night made two changes to the Cash-for-Clunkers program advocated by NADA. These changes are effective immediately. 
 
(1) Dealers may now choose to disable the engine of the trade-in vehicle after they receive payment from the government for the credit. In other words, dealers no longer must disable the engine before submitting a reimbursement claim. However, until the vehicle's engine is disabled, the dealer must store the vehicle at a location under the control of the dealership. Dealers must disable the engine within seven calendar days after receiving reimbursement. The certifications on the
Summary of Sale form (See page 18 of attachment) have been amended, and the certifications on the electronic form submitted by the dealer will soon be changed.
 
(2) NHTSA will no longer require proof of insurance from Wisconsin and New Hampshire residents because these states do not require insurance.
NADA Latest Updates (7/31/09)

"CASH FOR CLUNKERS" A BIG WINNER WITH CONSUMERS

Just five days after the start of the CARS (a.k.a. Cash for Clunkers) program, the National Highway Transportation Safety Administration (NHTSA) made the announcement that the $1B in funds appropriated for the program had already been allocated. No one could have predicted such a swift and immediate response by consumers to the CARS program. On Friday, the US House of Representatives voted 316-109 to send an additional $2B to the CARS program, before they left for their August recess. The fate of the CARS program now lies with the Senate, where it is expected to face significant challenges. The Cash for Clunkers program passed the Senate by a mere one vote the first time.

We continue working with the White House, DOT, and key legislators to ensure these problems are corrected as soon as possible. CONSUMER ASSISTANCE TO RECYCLE AND SAVE (CARS) ACT OF 2009 TAXABILITY OF PAYMENTS TO DEALERSHIPS - IRS ADVISORY

The IRS Motor Vehicle Division issued the following advisory alert on Friday of last week. It states that the federal CARS, aka "cash for clunkers" rebates and any money received as scrap value are taxable to dealers - in addition, any expenses incurred in this type car deal are deductible.  

Note that Automotive News last week had run an article indicating the rebates were not taxable to dealers.

HOW DO YOU KNOW IF A BRAND EXISTS WITHOUT A TITLE?
 
The question has come to ITD, "How do you know if a brand exists if you don't see a title?" Many customers who are financing will obtain a Carfax or Auto Use from their lienholder before purchasing, however, some wait until after they have purchased. How can a dealer protect himself from selling an 'unknown' salvage or branded title? There is one simple way, and that is to do the research before selling a vehicle. Even if a person trades a vehicle into you and signs a disclaimer, you may want to go through the expense of researching the vehicle, rather than a lawsuit and court appearance later. By law, any titled owner who has owner retained salvage must obtain a Salvage Certificate within 30 days of the declaration. Insurance companies must always notify ITD when there is an owner retained salvage, and we indicate this on our title records. The fine for an owner retained vehicle who fails to obtain the salvage certificate is $1000 and/or six (6) months in jail.
 
Remember, if you call ITD and ask questions that only require a yes/no answer, there is no charge for this information. We are only verifying your questions. Also, there is 24 hour access to our online records through itd.idaho.gov; however, there is a $5.50 charge for each inquiry. Older Idaho salvage vehicles (prior to 7/1/08) had a decal placed in the driver's side door post, so you should always inspect a vehicle when accepting it for trade.
 
PRESERVE ORIGINAL RECORDED DATE FOR FINANCING CHANGES
 
When the financing of the dealer contract changes and the title application has already been submitted, and/or has been issued with the incorrect or missing lien holder name, the original application recorded date can be preserved when ITD issues the corrected title. The dealer must sign a statement that the lien holder information is being corrected. By having this statement it clarifies there was no refinance or new dealer contract drawn up subject to a new recorded date. If the title was issued electronically, or the original application is still in process, the lien holder information on the title will be corrected in house at ITD with no fee. Fax the correction request to ITD at (208) 3348658. Include a corrected copy of the 502 and signed dealer statement. If a paper title was issued, the title must be returned to ITD or a county agent with the $8 title correction fee, and signed statement from the dealer. Making the corrections on a copy of the dealer application instead of the title clarifies further that this is not a refinance. Do not have an incorrect electronic lien holder print and/or change the title themselves, as this creates a new recorded date and moves the original record to history at ITD. If the new date is past the 30 days from delivery date, the title still needs to be corrected.

'Red Flags' Rule Delayed Until November 1

The Federal Trade Commission staff will redouble its efforts to educate small businesses and other entities about compliance with the "Red Flags" Rule. The FTC hopes to ease compliance by providing additional resources and guidance to clarify whether businesses are covered by the Rule and what they must do to comply. To give creditors and financial institutions more time to review this guidance and develop and implement written Identity Theft Prevention Programs, the FTC will further delay enforcement of the Rule until November 1, 2009. Trade Appraisal Opportunities in a Transparent Market

Most dealerships can precisely cite the number of daily walk-ins, telephone inquiries, Internet opportunities, demo rides, walk-around presentations, sales made, cars delivered, and customer satisfaction results. When it comes to the number of vehicles appraised, the specific appraisers, and the daily, weekly, and monthly trade capture rates, however, the answers become increasingly vague. This, despite the fact that the appraisal process involves hundreds of thousands of dollars and directly influences the number of new and used vehicles sold. The importance of sound and effective appraisal processes is magnified today by the fact that consumers now have strong knowledge of the dealers' cost and competitive offerings.
