CASH FOR CLUNKERS
 
CASH FOR CLUNKERS: IDAHO SALES TAX

The Idaho State Tax Commission has issued a memo to address the application of sales/use taxes to the federal rebates available under the CARS / "Cash for Clunkers" program. In summary:
  • The federal rebate is taxable and does not reduce the purchase price for calculating sales taxes in Idaho
  • Additional trade-in allowance given to the scrap value of the car is not taxable, and is considered just like other trade-ins


REMINDER: Please keep in mind that while the program dates are July 1st through November 1, 2009, the National Highway Traffic Safety Administration (NHTSA) still needs to finalize detailed rules and create an online system to implement this program.
Because key aspects of the implementation are not yet final, IADA does not recommend that dealers provide customers with credits based on an expectation of being reimbursed through a yet-to-be-defined process. For dealerships that choose to take the risk and provide rebates on deals that could ultimately not qualify, ensure you review all details possible of the parameters defined by the laws governing the program. One of those is that the dealer must "give the credit to the consumer at the time of such transaction."

 
IADA now has a link to the "cash for clunkers" program information on our main web site, www.idahoada.org. We will keep this information updated as more information becomes available, and highlight any updates in future issues of the Traffic Report. The estimated date for the program rules and implementation details to be available is July 23rd.

REGULATORY UPDATES
 
IDAHO ATTORNEY GENERAL FILES OBJECTION IN GM BANKRUPTCY
 
Attorney General Lawerence Wasden has joined more than 37 other attorneys general from across the country in objecting to General Motors' bid to unfairly modify its auto dealership agreements as part of its bankruptcy case in a New York federal court.  
 
According to the joint objection GM is effectively forcing dealerships to substantially modify their agreements with the company or risk being closed. Under Idaho law, it is unlawful for an automotive manufacturer to coerce a dealership to accept an onerous dealership agreement through the threat of canceling or not renewing an existing dealership agreement. Idaho also has concerns that the sale order GM is seeking in its bankruptcy case could undercut Idaho's regulation of manufacturer-dealership relationships. Special concessions, which would apply to a reorganized GM after the bankruptcy sale is completed could upset the even playing field all automotive manufacturers and dealers enjoy in Idaho. IMPORTANT ITD/DMV FEE UPDATES 

 
There will be many fee increases that will take effect on January 1, 2010 that you need to know about.  

 

Here is a list of the fee increases that will definitely affect dealers and their customers! REMEMBER these fee increases begin January 1, 2010!

  • 30 day temporary registrations sold to out of state residents who purchase from you: $180/book of 20
  • Initial Dealer License: $190.00
  • Dealer License Renewal: $175.00
  • Dealer License postmarked 30 days after expiration date: $190.00
  • Salesman applications: $26.00
  • Out of State Distributors: $175.00
  • Distributor Representatives: $44.00
  • Duplicate dealer license: $18.00
  • Dealer ID or Salesperson ID: $18.00 plus addition $10 to county
  • Dealer's Supplemental Lot, Location Change or Temporary Supplemental Lot (tent sale): $44.00
  • Group of dealer Temporary Supplemental Lot Sales (tent sales - 2 or more dealers together): $88.00
  • Title fees or duplicate title fee: $14.00
  • Rush title fee: $26.00 plus a $14.00 title fee= $40.00 total
  • MVR: $7.00 per record
  • Certification of MVR: $14.00
  • Duplicate Registrations: $5.00
  • Replacement Registration decal: $2.00
  • Vin Inspection fee: $5.00
  • Release of Liability: $3.50
  • Stop for titles: $21.00
  • TOD (transitional ownership documents): $26.00
  • Reassign orAssign new vehicle identification number: $18.00
  • Research of titles, vehicle, registration of driver's license per hour: $18.00

RESTRICTED USE DEALER PLATES

 

We now have a Restricted Use Vehicle Dealer Plate that can be purchased by licensed Idaho dealers for $20 each. The plate is black lettering on white background and has "DLR" with your dealer number and sequential plate number. The dealer plate sticker expires the same as all other dealer plates, the dealer license expiration date.

 

The Department of Parks and Recreation sticker is not required for a Restricted Use Dealer Plate. The Idaho Transportation Department has an agreement with Parks & Recreation to waive their requirement for the offroad sticker for dealer demos.

 

A message has been sent to law enforcement to allow county road use and offroad use on an RU Dealer Plate without a Park & Recreation sticker.

 

Dealers may still purchase only offroad stickers for their inventory, but only if the offroad vehicle is actually never going to be operated on county roads and is being used off road only.

 

However, you need to be aware not only would your retail customer, who needs a regular county Restricted Use plate, have to purchase the plate if they plan to operate on local county roads open to such operation, but they will also have to purchase another offroad sticker again for the plate.

 

In the long run, for demo purposes, dealers would probably save money using the RU Dealer Plate because it can be transferred from vehicle to vehicle; whereas, the sticker is issued to and applied to the fork or fender of a specific vehicle and can't be transferred if your customer needs an RU plate.

 

The 'sticker only' option must be in the dealership name only. If a personal name is reflected on the registration database, sales tax is due.
