RED FLAG RULE GUIDANCE
Under the new federal "Red Flags Rule," most Dealers and other creditors must develop and implement a comprehensive Identity Theft Prevention Program by Nov. 1. To assist with compliance, NADA has issued A Dealer Guide to the FTC Red Flags and Address Discrepancy Rules: Protecting Against Identity Theft. The Guide explains the requirements under the new Rules, and includes detailed, step-by-step guidance on developing the written program required under the Red Flags Rule, as well as a sample written program, worksheets, and other helpful materials.
All members will should have recieved one free copy of the full Guide in the mail. The sample written program is also being made available upon request as a Word document - free to members - to aid dealers in developing written programs specific to their dealerships in advance of the compliance deadline. Dealers wishing to obtain more information about compliance with the FTC's Red Flags Rule have the opportunity to order the F&I Manager's Guide to the Red Flag Rule. This guide was created by David Robertson, who is a founding member and owner of the Association of Finance and Insurance Professionals (the sanctioning body of the F&I trade in the United States).
The F&I Manager's Guide to the Red Flag Rule was designed to provide dealers with information and support material needed to establish an Identity Theft Prevention Program, as mandated by the FTC. The rule's enforcement date is November 1, 2008. Dealers must have a plan in place regardless of whether the processes required by the rule are handled by outside vendors.
As with the other AFIP dealer programs, the guide is based on the best legal opinions available, but it isn't offered as legal advice - it is a practical solution to establishing an Identity Theft Prevention Program. The guide provides:

Instructions on what is required by the rule

Rewritable templates on a CD to tailor a corporate policy unique to each store's situation, and modifiable job descriptions, and word track material

F&I office signage and other supplemental information
As structured, a corporate compliance officer is responsible for the development, implementation, and management of the program. The main focus of the F&I staff is to wire deals and sell aftermarket products - their duties relative to the rule are to collect customer information and seek clarifications. The red flag coordinators are responsible for evaluating possible indicators of identity theft (red flags) and determining the best course of action. The guide does not add any additional forms to the F&I process.

2009 NADA CONVENTION & EXPO
January 24-27, New Orleans, LA
Registration is now open for the 2009 NADA Convention, themed "Voice of the Dealer...Committed to Community." IADA reminds dealers that convention registration is required before reserving a hotel room. Since hotel rooms fill quickly during the convention, it is recommended that dealers register for the event early to ensure they are able to reserve a room at the hotel they desire.

2009 in New Orleans | In recognition of tough economic times, registration fees and hotel rates have remained unchanged, and discounted airfare is available. More than 700 exhibitors, 150 dealer workshops, a heavy-weight lineup of speakers and an additional half-day of workshops, including "Lifeline to Profit$ (offered both Friday and Tuesday), are slated for the NADA convention.
