Adverse Action Notices & Red Flag guidelines are top-of-mind in the financial services industry as institutions prepare to comply with sections 114 and 315 of the Fair and Accurate Credit Transactions Act of 2003 (FACTA). You will hear an overview and the primary points of interest and gain insight into the compliance issues facing dealerships across the nation. You'll also learn why your dealership should be on the track to compliance and how ACC's integrated tools can help enhance and facilitate your readiness efforts.

2009 NADA CONVENTION & EXPO January 24-27, New Orleans, LA
Advance registration is now open for the 2009 NADA Convention, themed "Voice of the Dealer...Committed to Community." IADA reminds dealers that convention registration is required before reserving a hotel room. Since hotel rooms fill quickly during the convention, it is recommended that dealers register for the event early to ensure they are able to reserve a room at the hotel they desire. Dealers should also make travel arrangements as soon as possible.
Additional details, including registration instructions and hotel details, are available on NADA's Web site at www.nada.org/convention. NADA DEALER ATTITUDE SURVEY GOES ONLINE
NADA 2008 Dealer Attitude Survey ENDS This Thursday, Aug. 7
The NADA Dealer Attitude Survey (DAS) is now going to be collected and managed exclusively on line. Under the new system, NADA will no longer mail paper surveys to dealers. The move to online-only will significantly speed up survey processing time and allow NADA Industry Relations to report the results of face-to-face DAS meetings with manufacturers back to the dealers who completed the survey.
"The online-only methodology allows us to provide important and timely information to dealers in a manner that previously was not possible" noted Michael Regan, NADA's VP of Industry Affairs.
NADA has designed a new full-service DAS website at www.nadasurvey.com to facilitate the move to online-only. CLICK HERE for more details.
HAZMAT TRANSPORTATION REGULATIONS
From the July 2008 NADA dealer ops newsletter Dealers should understand that the "hazmat transportation regulations" actually consist of multiple, similar-sounding regulations across different federal agencies and even across different countries.
The Hazardous Materials Regulations (HMR). Dealership employees who perform one or more packaging, hazmat transportation or pre-transportation functions are subject to the HMR, including applicable training requirements. Dealerships handling hazmat should become familiar with applicable provisions of the HMR.
Among international standards are:
-
Canada's Transport of Dangerous Goods Regulations (TDGR). The U.S. and Canada have a reciprocity agreement allowing the use of each other's standards for transport of hazmat between them.
-
Mexico's Normas Oficiales Mexicanas (NOMs). As the U.S. does not have a reciprocity agreement with Mexico, the U.S. requires that all shipments to and from Mexico comply with HMR.
-
International Civil Aviation Organization (ICAO) Technical Instructions. These are the official rules for the transport of hazmat aboard aircraft. Although these rules are closely aligned with the HMR, there are some important differences. Many air carriers require compliance with the International Air Transport Association's Dangerous Goods Regulations, which are generally more restrictive than the ICAO Technical Instructions.
-
International Maritime Dangerous Goods (IMDG) Code. These are the official rules for the transport of hazmat aboard passenger and cargo vessels. Many carriers require compliance with international standards as a matter of business practice.
U.S. Occupational Safety and Health Administration (OSHA) Hazard Communication Standard (Hazcom). The hazcom or "Right-to-Know" standard requires dealerships to classify and identify chemical hazards to which employees might be exposed.
U.S. Environmental Protection Agency (EPA) Hazardous Waste Rules. The EPA administers various rules governing hazardous waste.
This article is excerpted from The Federal Hazmat Transportation Regulations: Third Edition (L37). The publication can be ordered online at www.nada.org/mecatalog or by calling NADA at (800) 252-NADA, ext. 2.
