IADA Legislative Report Week #12

Personal Property Tax Removal:  In a disappointing move, yesterday HB 599, the bill to phase in a repeal of the personal property tax on business equipment, was drastically amended in the Senate.  Senators changed the bill to exempt just the first $75,000 in value from the tax on business equipment, and to exclude operating property.  The coalition of 23 statewide association has been working on this legislation for months and was confident of a successful Senate floor vote before a two-hour Senate caucus meeting on Wednesday.  Shortly following the meeting the bill was sent to the amending order. IADA will continue to work with legislative officials and other interested groups to craft legislation to ultimately eliminate the personal property tax in a manner that is fair and fiscally responsible. 

IADA wishes to thank all of our members and friends that supported HB 599 and contacted their legislators.  Without your efforts we would not have been as close to success as we were. 
 
GARVEE Bonding:  Gov. Otter's proposal for $134 million in additional bonding next year for the GARVEE highway bonding program won strong support from both the House and the Senate.  IADA supports GARVEE and has worked with a coalition of groups to educate members as to its economic stimulus benefits to Idaho. Look now for many new project to begin construction since much of the work that has been done to date has been preliminary.
 

Air Quality and Vehicle Inspections:   HB 586 has been passed by the Senate. After being signed into law by the Governor this legislation will become effective July 1, 2008.  HB 586 which would allow vehicle emission testing in regions that approach non-attainment of federal air quality standards.  CLICK HERE to read to IADA letter to the House Environment Committee

 

Employer Protection Act: SB 1393 has been signed by the Governor and will become law July 1, 2008!   

This issue was brought forward to create assurances that the contracts employers have to protect their businesses can be legally made and are enforceable.  

 

Transportation Funding:  With the end in sight it seems that addressing the funding shortfall at the Idaho Transportation Department for roads is all but over for 2008.  No compromises between the Governors office and the legislature could be reach in an effort to address an estimated $200 million shortfall in the states highway system.  IADA will be closely monitoring the interim discussions as to what will be brought forward in 2009. 
 

Titling of Slide-In Campers:  HB 440 has been signed by the Governor and will become law Jan. 1, 2008. This proposal will require the titling of pickup-mounted campers which meet the same requirements as recreational vehicles, and are at least 6 feet overall length and contain at least one facility as listed in this proposed legislation.

 
THEY ARE GOING HOME!  After finishing a bulk of the work left for the 2008 legislative session the word on the street is that legislative members are scheduled for adjournment on Wednesday, April 2nd!

    You could say that if European cars shrunk any more we might as well all drive around in hybrid golf-carts.

    But the European Union's (E.U.) likely insistence on savage new fuel efficiency targets will lead to another round of weight slashing and downsizing. Unless some new technology miracle suddenly brings the carbon age to an end, cars here will look more like invalid carriages, able to overtake bicycles with ease going downhill, with a following wind.

AUTOMOTIVE CAREERS ONLINE:
 

 

Recently, NADA launched Automotive Careers Online, which provides job seekers with access to the best employers and jobs in the car and truck retailing industry.  CLICK HERE to take a test drive of this new program on the IADA website.  Job seekers can post their resume, search available job postings and create job alerts for free.  This competitively priced, NADA member-exclusive benefit allows dealers easy online management of job postings, access to a searchable resume database, and automatic email notification when new resumes match their criteria.  

 
LAST-IN, FIRST OUT (LIFO):    
 
  Did you see it?  In a significant victory for franchised dealers, NADA has secured from the IRS a revenue procedure (2008-23) that permits taxpayers who use the Last-In, First-Out (LIFO) accounting method to place: (i) new cars and light-duty trucks in a single LIFO pool, and (ii) used cars and light-duty trucks in a single LIFO pool.  As noted in a March 10 memo to ATAEs and NADA directors explaining the revenue procedure, this eliminates the administrative inconvenience, costs, and audit exposure that result from having to determine on a yearly basis whether crossover vehicles need to be placed in the LIFO pool for cars or the LIFO pool for light duty trucks.  Revenue Procedure 2008-23 favorably responds to a January 2007 NADA request that the IRS consider providing this relief as part of the Industry Issue Resolution Program.  Please contact NADA's Paul Metrey (pmetrey@nada.org) for additional information.

NADA's Regulatory Review, which is published quarterly by the NADA Public and Legal Affairs Groups, contains the latest federal regulatory developments that affect franchised new-vehicle dealers. Regulatory Review is now available on NADA's Web site atwww.nada.org, under "Publications" (member login required).
