IADA Legilsative Report Week #9

Personal Property Tax Removal:  HB 599 will be heard next Tuesday in the House Revenue & Taxation Committee.  To date over 2500 responses have be mailed in from the mailers that were set out late last month.  If you have not done so already please take a moment and go to www.endthetax.com to fill out your support petition form and click send!  Endthetax.co provides talking points and links to legislators for businesses to access information and show legislators their support for the bill. 

GARVEE Bonding:  Gov. Otter's proposal for $134 million in additional bonding next year for the GARVEE highway bonding program won strong support in the Joint Finance-Appropriations Committee this morning, passing on an 18-1 vote.  IADA supports GARVEE and has worked with a coalition of groups to educate members as to its economic stimulus benefits to Idaho. 
 

Air Quality and Vehicle Inspections: After addressing concerns from several outside groups the authors of HB 482 have reintroduced this bill as HB 586.  HB 586 which would allow vehicle emission testing in regions that approach non-attainment of federal air quality standards, passed 42-26 on Friday morning and is now headed to the Senate Resources and Environment Committee.  IADA has been assured that these standards will be flexible enough to account for a vehicle's age and type and only enforced in those regions of the state with air-shed's rapidly approaching non-attainment.  This legislation will only address "registered motor vehicles". CLICK HERE to read to IADA letter to the House Environment Committee

 

Employer Protection Act: S. 1393 cleared a major hurdle by passing out of the Idaho Senate and will next be heard on March 18th in the House Business Committee.  IADA supports S. 1393 and asks that you contact your local representative and ask them for their support of the vital piece of business legislation.    

This issue is being brought forward to create assurances that the contracts employers have to protect their businesses can be legally made and are enforceable.  

 

Principal Place of Business: After getting off to a good start with this piece of legislation ITD and the IADA were unable to get this legislation passed out of the Senate Transportation Committee.  Committee members cited the grandfathering-in of existing dealers and lack of a consumer protection piece with teeth as their reason for voting against this bill.  ITD and IADA will reexamine this legislation during 2008 and make the appropriate changes for reintroduction in 2009. 

 

The legislation would have modified the definition of "Principal Place of Business" relating to licensed dealers by adding requirements to include that the commercial structure be sitting on a foundation, and must have permanently installed utilities, including power, water, restrooms and a hardwired telephone.

 

Titling of Slide-In Campers:  Almost done!  After some last minute negotiations with Senate leadership an amendment was drafted and added to HB 440 thus securing is passage out of the full Senate.  Since an amendment was added the bill now must travel back to the full House of Representatives for final approval.  HB 440 is now HB 440aaS. Baring any last minute hiccups with the full Senate HB 440aaS will go into effect early next year. Currently there is no opposition to this proposal and IADA has the full support if ITD.

 

This proposal will require the titling of pickup-mounted campers which meet the same requirements as recreational vehicles, and are at least 6 feet overall length and contain at least one facility as listed in this proposed legislation.

 
Grocery tax credit:  After much debate, the House has voted 62-8 to pass HB 588, the grocery tax credit increase bill.  The credit would rise to $50 for low-income Idahoans next year, and to $30 for most everyone else, from its current $20 level. It would rise by another $10 per year, economic conditions permitting, until it eventually hit $100 a person. The bill also extends the credit to the poor, who are now excluded; Idaho's current grocery tax credit is available only to those who make enough to be required to file income tax returns, unless they're elderly, blind or disabled veterans.

LEGISLATIVE & REGULATORY UPDATES
 
ECONOMIC STIMULUS PACKAGE 

President Bush signed an economic stimulus package (H.R. 5140) on Feb. 13 including the following provisions that are expected to put more money in the hands of small-business owners, allowing them to expand and buy new equipment:

Enhanced small business expensing under section 179.  Doubles the amount small businesses can immediately write off their taxes for qualified expenditures in 2008 from $128,000 to $250,000 for purchases of new equipment of up to $800,000 (increased from $500,000). (However, certain SUVs that are rated at 14,000 pounds gross vehicle weight or less are still limited to the $25,000 section 179 limitation.)  

Accelerated bonus depreciation.  Provides for immediate tax relief for businesses to invest in new machinery and equipment, including vehicles, by accelerating depreciation schedules, through an additional 50 percent bonus depreciation of new qualifying property purchased in 2008. 

Direct consumer stimulus.  Provides one-time rebates of up to $600 for individual taxpayers earning $75,000 or less, or $1,200 for couples earning $150,000 or less, with $300 for each child. Additionally, retirees on Social Security, low-income workers, or disabled veterans would receive $300 checks. These rebates could be in the mail as early as May.  NADA will continue with legislative updates on the stimulus package and on a possible second tax package with energy credits as the issues continue to develop.

Credit for certain hybrids begins to phase-out

The IRS has announced that the phase-out period for Honda hybrid tax credits began on January 1, 2008.  Only qualifying vehicles purchased prior to this date can claim the full credit.  To view the full credit amounts for all qualifying vehicles, as well as phase-out dates and their respective credit amounts, please visit www.fueleconomy.gov and choose hybrid vehicles, tax incentives.

NADA's Regulatory Review, which is published quarterly by the NADA Public and Legal Affairs Groups, contains the latest federal regulatory developments that affect franchised new-vehicle dealers.
