"Do not think a man has done his full duty when he has performed the work assigned him. A man will never rise if he does only this. Promotion comes from exceptional work."

Where's The Money?

"Follow the money." Quoting Deep Throat in All the President's Men, investigative journalist, Bob Woodward, struck a chord that resonates still today with litigators and business people everywhere. Finding out "who has how much of what" is critical to equitable settlements.  Back in the 1970's - when the Watergate scandal ran amok - attorneys, investigators, and forensic accountants had considerable leeway to ferret out hidden cash flows and surreptitious accounts.

Unearthing critical data is no longer that easy. For example, one old-school investigative technique, called "pretexting," involved the contrived "spoofing" of banking officials to obtain accurate financial records. Today, such practices are illegal.

How Privacy Legislation Affects You

Today, the titles to cars, boats, and planes; property and tax records; life insurance policies, investment records, details on personal shopping habits, political affiliations, and health care records, are all digitized and filed away in somebody's database.

Optimally, access to all this data should ease the burden on investigators and attorneys to find witnesses and track down assets. However, pending legislation puts legitimate database access in danger.

The problem is complex. According to PrivacyRights.org, between January 10, 2005 and March 2, 2010, a whopping 346,512,902 private database records, containing sensitive personal information, were compromised due to security breaches. This is the statistical equivalent of more than one record compromised for each man, woman, and child in the United States.

Child Support: Getting Yours...Or Not

One of the consequences of divorce, if children are involved, is child support. If you're one of the fortunate custodial parents who is receiving all the financial support that you're entitled to, congratulations! You're in a statistical minority, however. When it comes to child support, the facts are pretty dismal. In Florida, 826,000 children are owed $4 billion in support, and only 39% have received at least one payment! In fact, only 25% of all cases receive total payments! If you're receiving support, or are trying to collect, I recommend you ...Read More
