NRHA update on Medicare reimbursements for physicians:

On Friday May 28, the House of Representatives passed HR 4213. The bill included a provision that would continue to prevent a 21.2% Medicare payment cut to doctors that was due to take effect June 1.  The "doc fix" extension was, however, scaled back with many other parts of the bill. While it was originally extended for another three and a half years, the final version scaled this extension down to only 19 months.  In addition to cutting back the length of the extension, some members of the House also fought to scale back extension to FMAP payments and federal COBRA subsidies. Ultimately these two provisions were left out of the bill entirely.
 
It is now up to the Senate to act on this legislation upon returning this week from the Memorial Day recess. In light of the delay and these cuts occurring during a congressional recess, CMS has advised its contractors to hold off on filing claims for two weeks until July 14.  This allows the Senate to return and vote on the bill before doctors would feel the worst effects of the cuts.  Unfortunately however, this assumes that the Senate will not make any changes to the bill. If changes are made in the Senate's version, it would then have to return to the House and be voted on again. The short time frame with which Congress has to work has led several interest groups to suggest that the instability in Medicare reimbursements due to continuous "band-aid" fixes will lead to physicians limiting or totally eliminating care for Medicare patients.
 
While whatever provision Congress passes to prevent these cuts will likely be retroactive, it's not clear that the Senate will have the votes to pass this bill without significant changes when it returns on June 7 further exacerbating an already tenuous situation.
