OBAMA SIGNS SMALL BUSINESS JOBS ACT

On September 27, 2010, President Obama signed into law H.R. 5297 as the Small Business Jobs Act of 2010.

The Act will affect Small Business Administration Lending, including:
Guarantee level. Increases guarantee level of SBA 7(a) loans from 75 percent to 90 percent.
Loan limits. Increases 7(a) loan limits from $2 million to $5 million, 504 loan limits from $1.5 million to $5.5 million, 7(a) Express Loans from $300,000 to $1 million, and microloans from $35,000 to $50,000.
Borrower fees. Extends waiver of borrower fees on 7(a) and 504 loans through 2010.
Exports. Expands SBA trade and export finance programs.
Alternative size standards. Directs the SBA to set alternative size standards for 7(a) and 504 borrowers based on net worth and net income. Present size standards are based on employees or annual receipts.

The following is a brief summary of the tax provisions. In particular, the Act (1) increases the Section 179 expensing deduction limits; (2) expands Section 179 expensing to include qualified real property; (3) extends the 50% bonus first-year depreciation; (4) increases the first-year depreciation for passenger
automobiles, light trucks, sport-utility vehicles and minivans; (5) increases the deduction for startup expenses; (6) increases the exclusion for gain from the sale of qualified small business stock; (7) extends the carryback period for
general business credits; (8)reduces the holding period for built-in capital gains; (9) allows self-employed individuals to deduct from their net earnings certain health insurance costs; and
(10) removes cell phones from the provisions relating to listed property. The Act also imposes new reporting requirements and increases
penalties for failure to file or furnish certain information returns.
