October is an ominous month for inventors as Wal-Mart announces big price cuts in time for Christmas.  This happened for the first time last year, also in mid-October, right in the middle of the Canton Import Export fair held in Guangzhou, China, which is close to Hong Kong.  The two events are connected in more powerful ways than most people imagine and they have a very large impact on American inventors because together they symbolize a dramatic shift in the American consumer goods market, forcing inventors to either go after niche markets or have a very high level of innovation.

moneyman Inventor Story: Jim Koller and Lee Roehrig

Jim Koller and Lee Roehrig were friends who both had independently come up with ideas to keep their downspouts up off the grass and out of their mowers' way.  One evening, Koller mentioned his idea to Roehrig and they decided to bring the idea to market together.

They found local manufacturing and got the product ready for sale.  They managed to get their product in a few local hardware stores, but it didn't sell.  They sent sales materials to catalogs and talked to landscapers and builders, but never heard back from them.

Here's the usual scenario I'm faced with:  Good friends, or even siblings, come to me and ask for my assistance on some legal matter.  As I consult with them I learn - more often than not - that they are "partners", yet have not created a partnership agreement.  Why?  I always ask the same question and more often than not get the same answer:  because we're friends, they say.  Because we trust each other.  Because none of those awful things that happen to other people will ever happen to us.

This will probably be one of the hardest tasks you have associated with getting your product to market. Many packaging manufacturers simply don't handle small quantities so it's important to find a supplier that works with minimum quantity or small quantity orders at the very beginning. Fortunately there are now many resources available to someone starting the process of packaging their product.
