Question of the Month

Q: Is there any grace period of time allowed  between stopping work at the old employer and filing a new H-1B (or beginning the new employment) or is any gap considered being out of status? Do I essentially lose my current H-1B status as soon as I stop work with my current employer?
 
A: You must have your new H-1B filed before leaving the new employer. There is no grace period so if you leave before filing a new H-1B, you will lose your current H-1B status.

Welcome back to Badmus Law Firm's monthly newsletter for physicians! 
 
In the immigration world there is only one constant.....change.  This newsletter is geared towards providing information focused solely on physician and medical employers. We want you to stay informed and current on immigration issues affecting the medical profession. October 1, 2009 is the first day of the new fiscal year for immigration purposes, therefore, September has traditionally been a quiet month.  This newsletter will provide you with updates on H-1B's and J-1's, in general.  We are starting a new section, this month, which will include current employment oppurtunities.

J-1 Visa Waiver State 30 Programs open on October 1 !!!

 
For immigration purposes the new fiscal year starts on October 1, 2009, which is the date most state 30 programs start accepting J-1 visa waiver applications.
 
It is important to remember that the J-1 waiver Conrad State 30 Program is only one of the programs available to obtain a J-1 visa waiver. Other programs include the Appalachian Regional Commission (ARC), the Delta Regional Authority, the Department of Health and Human Services (DHHS) , and the Department of Veterans Affairs (VA) Waiver program.   For more information regarding these programs, click here.

Priority Date Update

 
 The Department of State released the Visa Bulletin for the month of September.  
 
The priority dates for the month of October (new fiscal year starts) move forward to March 22, 2005 for physicians born in China mainland and January 22, 2005 for physicians born in India.  For the other countries in the EB2 category, the priority date continues to be current. 
 
No changes in the EB1 category, where the priority date continues to b current. In the EB-3 category, the priority date for all countries including China mainland, India, Mexico and Philippines is January 1, 2001. For India, the priority date is April 15, 2001.

H-1B Visas

 
H-1B visas are still available!!!!!!  If you are not exempted from the numerical limitation, you can still apply for an H1B visa.
