I am currently working with the private practice that sponsored my J-1 visa waiver and H-1B visa. My job requires me to admit (and see) my patients at the local hospital, where I have privileges.  The hospital has asked me to work (moonlight) with them a few hours a week. Can I work with the hospital based on my current H-1B visa?  

Answer:
 

No. Your current H-1B visa allows you to only work for your current employer.  To work with the hospital a few hours per week (or per month), the hospital will need to sponsor you for a "concurrent" H-1B visa. The concurrent H-1B visa application must be filed with the Citizenship and Immigration Services (CIS) before your first day of employment with the hospital.

Congress Passes Conrad 30 Extensions
 
Both houses of Congress have passed a stop-gap measure that will extend the Conrad State 30 Waiver Program until March 6, 2009.  The sole substantive change from the existing legislation is that the "Flexibility Waivers" have been doubled from five to ten waivers per year.  This will provide state departments of health increased flexibility to recommend waivers to meritorious placements in which the physician will serve indigent and the medically underserved patients even though the physician's physical location of practice is not located in a designated medically underserved area.
 
This enactment is now being sent to President Bush who is expected to sign this legislation within the next 10 days!!!

DO consult with your attorney before changing employers, accepting new employment or starting to work with a new employer because your immigration status may depend on your employment arrangements.
 
DON'T believe that your H1B visa is a "blank" authorization for you to work with any employer in the United States.

Delta Regional Authority Waiver
 
The Delta Regional Authority(DRA) is a federal-state partnership serving a 240-county/parish area in an eight-state region. Led by a Federal Co-Chairman and the governors of each participating state, the DRA is designed to remedy severe and chronic economic distress by stimulating economic development and fostering partnerships that will have a positive impact on the region's economy. The DRA waiver requires the foreign born physician to practice at least 40 hours per week as a clinical care physician for a minimum period of three years at a health professional shortage area (HPSA) or medically underserved area (MUA) facility located in the Delta region.  The eight states included in the region are Alabama, Arkansas, Illinois, Kentucky, Louisiana, Mississippi, Missouri, and Tennessee.
The DRA waiver requirements are very specific and requires an application processing fee of $3,000
 
The DRA J-1 waiver process takes approximately three to four months. Once the review process is completed (and if the J-1 waiver application meets the DRA requirements), the DRA sends the application to the Department of State (DOS) with its recommendation to approve it. The DOS reviews it and (if it meets all the J-1 waiver requirements) sends its recommendation to the Citizenship and Immigration Services (CIS) for final approval.
