Rob Wendt wins important case before Fourth Circuit Court of Appeals

 

Though not very common, some disability cases are appealed to the United States Courts of Appeals, one level below the U.S. Supreme Court in the federal court system. Rob Wendt recently won a disability case before the Fourth Circuit Court of Appeals in Richmond, Virginia, which has been carefully watched by Social Security lawyers and judges.

 

The case of Meyer v. Astrue (No. 10-1581) was decided by the Fourth Circuit on December 2, 2011, in a published decision. The Court reversed and remanded the case for a new hearing because the Commissioner of Social Security failed to make findings of fact regarding new and material evidence from a former treating physician which was submitted on appeal to the Social Security Appeals Council. The Fourth Circuit also addressed the opinions of former treating physicians and the effect of frequent medical treatment on the ability to work -- important issues that frequently arise in disability claims. Congratulations to Mr. Meyer on this favorable appellate court decision.
