Emerson Good Samaritan Food Donation Act
Unused Food Goes to Individuals in Need
 Since, 1996, the Bill Emerson Good Samaritan Act releases restaurants, caterers, grocery stores and other food organizations from liability associated with the donation of unused food to nonprofits assisting individuals in need.
This Act is named after Representative Bill Emerson (R-Missouri), who fought diligently for the proposal before passing away from cancer, protects donors in all 50 states from civil and criminal liability for the good faith donations of "apparently wholesome food" defined as meeting "all quality and labeling standards imposed by Federal, State and local law and regulations even through the food may not be readily marketable due to appearance, age, freshness, grade, size, surplus or other condition."
