Take This Deduction Before Year End

As a business owner, you're likely envisioning the approaching New Year's Eve party, signaling the end of 2011 and any tax deductions your business might have qualified for this year. If so, you'll want to take note of the changes to the Section 179 tax code which allows deductions and "bonus" depreciation on certain business purchases.

Most tangible goods including"off-the-shelf" software, such as CAPSYS CAPTURE, Hyland OnBase, FileBound or Microsoft Dynamics, qualify for the Section 179 Deduction. Also, to qualify for the Section 179 Deduction, the equipment and/or software purchased must be placed into service between January 1, 2011 and December 31, 2011. If you've been considering the purchase of Enterprise Content Management (ECM), Accounting, Enterprise Resource Planning (ERP) or Customer Relationship Management (CRM) software, this is a great time to invest while you can still take advantages of the tax benefits for 2011.

What Software Qualifies?

For basic eligibility, the software must meet all of the following general specifications:

  1. The software must be financed (only specific type leases or loans qualify), or purchased outright by you.
  2. The software must be used in your business or income-producing activity.
  3. The software must have a determinable useful life.
  4. The software must be expected to last more than one year.

In addition, these three specific stipulations must be met:

  1. The software must be readily available for purchase by the general public.
  2. The software must be subject to a non-exclusive license.
  3. The software must not have been substantially modified.
