Governor's Cup(TM) 2013
We will be supplying information on Governor's Cup submittals very soon. For planning purposes, entries will be accepted December 10th - 21st. There will be other minor changes to the conditions for entry, but for the most part the competition will remain the same, due to its great success. Thanks again to the Virginia Vineyards Association and the Virginia Wine Board for their support!

Legislative Efforts 
The VWA Legislative Committee has identified several issues of concern for the industry. Some of these have become legislative priorities. VWA has developed a position on each of these priorities to be shared with the Virginia Wine Council, the industries lobbying arm.
1. Sangria & mulled wines 2. Barrel tastings - see Compliance Corner below 3. Growlers 4. County involvement in agricultural activities 5. Sales of wine to host winery for multi-winery festivals 6. Custom crush - please see the survey in the box below.
Please advise us if you have suggestions related to these priorities or have other issues you would like for the Legislative Committee to consider. Additionally, the Association's Legislative Policy will be brought before the membership at the Annual Meeting in November.

Virginia Wineries Association Cooperative
A cooperative has been formed by VWA for wineries and vineyards for three purposes:
- Collective Purchasing: Production costs for both vineyards and wineries could be reduced through collective purchasing of products and services.
- Marketing: Virginia law now allows collective marketing of wine. A VWAC electronic wine portal would allow sales of wine directly to customers in Virginia and other states.
- Service Provision: A VWAC fulfillment center would be available for packaging and shipping wine purchased through the electronic wine portal and for individual winery wine clubs.
The cooperative has received a Value-Added Producers Planning Grant and a Specialty Crop block grant to assist with the development of the cooperative. However, we need your help. Please take a few minutes to respond to this survey. Your feed back will be greatly appreciated.

Executive Director's Column
Some of you may know me, while others may not, so I will introduce myself. Your Board hired me as your Executive Director in January. My team has been working with VWA since 2009; however, our work has expanded significantly for the association. We hope you see all the things your association is doing for you. The VWA Board has tasked me with finding ways to better serve the membership. You likely have noticed improved communication and new or expanded programs. Here are some of the things we are working on for you:
- Created a Cooperative for Wineries & Vineyards. See the article below.
- Enhanced and Expanded the Governor's Cup™ Competition
- Created the separate Governor's Cup Gala
- Developed an educational series based on the Governor's Cup
- Created and launched the CQA program
- Retained legal counsel to help advise and counsel the membership
- Brought to you the Regulation Round Up
- Creating a guidebook for wineries on ABC and other issues
- Expanded the Preferred Partner program to bring even more cost savings to you
- Enhanced & expanded the Annual Membership meetings
This list is just some of the projects and work we have started; all while obtaining 6 grants (so far) to fund some of these initiatives. Yet, without your support and participation none of these things are possible. Be a part of it! We welcome volunteers to serve on our many committees. Please let us know how we can better serve you.

Commonwealth Quality Alliance
There is a lot of great news to share with you about the Commonwealth Quality Alliance (CQA) program. First, the deadline for free membership has been extended until December 31, 2012. This means you have time to enter your wines and receive a free entry for your approved wines into the Governor's Cup competition. Last year, we had dozens of CQA-approved wines enter the Governor's Cup at no charge. Another new benefit is the CQA stickers. Once a wine has completed the approval process, we will send you stickers to apply to your wines. Finally, we were recently awarded a $30,000 marketing grant to further market and promote the CQA program. Click here to read about all of the great benefits of the CQA program.
As a reminder, the $170 per wine fee covers the chemical analysis, the sensory evaluation and the shipping to Enartis Vinquiry.

Regulation & Rules Round Up October 30th at Doukenie Winery
On October 30th at 1 PM, we will be hosting the second Regulation & Rules Round Up at Doukenie Winery to answer your questions on some of the hot-button issues affecting Virginia wineries today.
As we did in the previous Round Up, we'll start the session with a closed-session discussion on some of the regulatory changes and interpretations that the wineries are facing - topics to include ABC issues, County Board of Supervisors actions, VDACS and Department of Health, and many more topics. Questions will be answered by Mary Beth Williams of Williams Compliance & Consulting and author of "Compliance Corner". Later, after we have the closed-session, we will also welcome Roger Stevens of the Virginia ABC to answer questions from an ABC standpoint to help you run your business in a manner compliant with the ABC laws.
You can submit your questions, beforehand by email or online, or the day of the event.
An additional opportunity will be offered from 10 AM - 12 PM before the Regulation & Rules Round Up, we will be holding a seminar entitled ABC Records & Reporting 101. Officials from Virginia ABC Tax Management will walk attendees through the monthly reporting requirements with ABC, and how to correctly complete and submit those reports. They'll also be available for questions, as a group or in private, should you have specific situations to run by them. This seminar is perfect for beginners and as a refresher for experienced report filers.
There will be a break between this seminar and the Regulation Round Up. Due to the limited restaurant options in the area, we will have box lunches available for those who are interested. The box lunches are $10 each and you can order yours when you register for the ABC Records & Reporting 101 seminar. Both seminars are complementary. Wine Bag Orders
One of the great member services VWA is able to offer is a discount on wine bags. We are now accepting orders for the white single-bottle wine bags with the Virginia First in Wine logo on them. Click here for the letter about the wine bag ordering and the order form. We also mailed out hard copies, look for them in your mailbox.
Payment is due at the time of your order. Orders are due by Friday, December 14, 2012. We only place the order once a year, so make sure to order enough to last you the whole year. This year, we will have pick up locations at three wineries, as well as on Friday, February 22nd before the Wine Expo.

Virginia Wine Expo Changes
There are many changes occurring related to the Virginia Wine Expo for 2013. First, VWA will no longer be the beneficiary of the event. The promoter chose Feedmore to fill this role for next year as he believed this would bring more sponsors and participants to the event. However, VWA will be endorsing the 2013 event. The VWA Board decided to show their support for the event given a certain set of conditions.
Most important of those conditions was that the event remains a Virginia wine event. Additionally, discounts will be given on booth fees for VWA's 2013 Silver (15%) and Gold (25%) members (dues must be paid by January 15th for the discount to apply). We are also told that the Expo floor will only be open on Saturday and Sunday, February 23rd & 24th. There will be 17 or more events held during and around the Saturday and Sunday Grand Tastings. With the Gala the evening of Thursday, February 21st, that should allow for set-up on Friday - don't forget the Membership Meeting on Friday as well. We look forward to seeing you Thursday and throughout the weekend.

Preferred Partner Spotlight
NASHVILLE, September 5, 2012 - Broadcast Music, Inc. (BMI), an American performing rights organization representing more than 500,000 songwriters, composers and music publishers, announced today the launch of a benefit program for members of the Virginia Wineries Association (VWA).
The program, the result of close communication between BMI and VWA, will provide substantial discounts on music licensing fees for qualifying VWA members. The discounts will be offered as a complement to the BMI license for eating/drinking establishments.
With the new program, qualifying association members will receive a 5 percent discount for their membership and an additional 5 percent discount when they license or pay in full online at www.bmi.com/winery. VWA members will also be eligible to receive a 10 percent discount for timely payment. When licensing or paying online, customers will receive all of the applicable discounts as they move through the licensing process.
"The Virginia Wineries Association is the perfect example of what is possible when an organization recognizes the tremendous business benefits of music and works with BMI to offer a simple licensing process with generous discounts to all its members," said Michael Steinberg, SVP of Licensing for BMI. "It was a pleasure to work with them and we are very happy to be able to implement this terrific program."

 The Compliance Corner By Mary Beth Williams Barrel Tastings The issue of barrel tastings keeps coming up, so let's get some clarification on the issue. Wine can be served, but not sold, from carafes and decanters, so it can be poured from the barrel into a container less than 52 oz and then poured into customers' glasses from there. If there is any fee associated with the tasting, then it is considered a sale of wine, rather than just service of wine. All wine SOLD must come from an original approved container. This would include tastings offered as part of a paid barrel tasting dinner or part of an event where an admission was charged, in addition to any situation where a tasting fee is charged. The best way to think of it is that if the tasting is only available to people who have paid any kind of fee, the wine is considered SOLD instead of just served. The VWA and VWC proposed regulatory changes that would exempt barrel tastings from the original approved container requirement, but in the meantime, you have a few options on how to get around this roadblock at this point: 1) get a COLA/label approval on the barrel itself; 2) get a COLA/label approval specifically used for the barrel tastings; or 3) if the wine is one for which you already have a COLA (ie. a new vintage of an existing product)/label approval, you can print labels (so long as the changes to the label are consistent with the allowable changes - see last Compliance Corner for guidance) and sell it under the existing label approval. Options 2 and 3 have become more viable with the expanded list of label changes allowed without needing a new COLA. It's important to note that state excise and sales/use tax is due on all wine used in barrel tastings. Tastings done on site are exempt from federal tax, but make sure you keep track of the amount of wine used for tastings so that it can accurately reflected on your federal and state reports.
