Dane County Circuit Court Judge rules portions of Act 10 unconstitutional
Dane County Circuit Court Judge Juan Colás struck down portions of 2011 Wisconsin Act 10, the law that among other things made changes to the collective bargaining process for public employees, declaring them to be unconstitutional.
Judge Colás decision came in a case brought by the Madison teachers union and a union representing employees of the city of Milwaukee. He ruled that several sections violated employees' rights of free speech, association and equal protection.
Reaction from political leaders was quick and remained, as would be expected, closely divided along partisan lines.
Governor Walker in a prepared statement stated, "The people of Wisconsin clearly spoke on June 5th, now, they are ready to move on. Sadly a liberal activist judge in Dane County wants to go backwards and take away the lawmaking responsibilities of the legislature and the governor. We are confident that the state will ultimately prevail in the appeals process."
Assembly MinorityLeader Peter Barca called the decision "a huge victory for Wisconsin workers and a huge victory for free speech," saying the decision would "help to re-establish the balance between employees and their employers."
Attorney General JB Van Hollen immediately asked Judge Colas to stay his decision pending appeals. Attorney General Van Hollen argued that granting a stay would provide certainty for municipalities and schools in determining employee compensation, work rules and their budgets until litigation regarding Act 10 is completed.
Judge Colas does not have a deadline to act on the Attorney General's request and the Attorney General may have to seek action by an appellate court to stay the decision until appeals are resolved.
In addition to this court case regarding Act 10, there are two other cases pending in federal court related to Act 10, brought by unions challenging the constitutionality of the law that remain ongoing.
Paul Jadin leaves post as head of Wisconsin Economic Development Corp.
Paul Jadin, Chief Executive Officer and Secretary of the Wisconsin Economic Development Corporation, announced this week that he was leaving the post to become president of Thrive, the economic development agency for the eight counties that surround and include Madison. Jadin was appointed by Governor Scott Walker to head the Department of Commerce when he first took office and then tapped him to lead the transition of the state agency to the quasi public-private economic development corporation.
State Agencies Submit Budget Requests to Governor Walker
On Monday, of last week, state agencies, with the exception of the Department of Transportation, were required to submit their 2013-2015 budget requests to the Governor's Office. Governor Walker requested that state agencies restrict their budget requests to funding levels for the current fiscal year.
Note these agency requests are the starting point from which the Governor and his Administration begin work on the state budget, and there will likely be significant changes to the agency requests as well as signature issues added by the Governor, before the Executive Budget is introduced for Legislative consideration in February of 2013.
A review by Wispolitics.com, an online news service covering the capitol, found that a third of agency budget requests included General Purpose Revenue (GPR) increases for the next two-year state budget.
Here are some additional highlights from the Wispolitics.com review:
- More than a third of agency budget requests included GPR increases for the next two-year state budget, which, if implemented, would amount to a 3.6 percent overall increase in funding from state tax dollars.
- Seventeen of the 42 agencies to submit budgets this week defied the request for zero growth in their GPR allocations, including the four largest consumers of current GPR dollars.
- Agency budget requests submitted this week showed a total state funding increase of more than $850 million above the base year doubled level of GPR of $23.9 billion. The state doubles the budget in the second year of the current biennium to serve as the benchmark for future budget requests. The new budget cycle begins July 1, 2013.
- The Department of Public Instruction, whose Superintendent Tony Evers is independently elected and not a member of the Governor's cabinet, submitted a request for $39.9 million in increased GPR; DPI currently takes up $10.3 billion of the $23.9 billion base year doubled GPR budget.
- The Department of Health Services -- the second largest allocation of current GPR, and by far the biggest state budget item when all funds are taken into account -- comprised the majority of budget increases requested this week. DHS is seeking $647 million in additional GPR and an overall increase of more than $1 billion in all funds compared to the base year doubled. Without the DHS budget factored in, the remaining agencies' overall funding requests total just a 1.1 percent GPR increase.
- The Department of Corrections requested a 1.1 percent budget increase above the third-largest current GPR level of $2.3 billion. Secretary Gary Hamblin wrote that the agency's overall increase accounts for current operations in correctional institutions and previous commitments -- including costs required to expand GPS monitoring of domestic violence offenders.
- UW System -- at $2.2 billion, the fourth-largest current GPR source -- is requesting an increase of 1.6 percent, or $36.8 million. The UW was particularly helped by a provision in the governor's directive that exempted current lapses from factoring into the next budget.
- Four agencies requested no additional funding; 15 sought cuts in their overall budgets.

US Senate Race Update
Control of the US Senate After a rough week of polling in Wisconsin Republican US Senate candidates several of the political tracking websites have moved a few "Republican leaning"seats into the "toss-up"category, including Wisconsin. - RealClearPolitics.com (48 DEM-44 GOP)- RCP has moved Wisconsin and Nevada from the "Lean Republican" to the "Toss-Up" category. RCP also moved Ohio from "toss-up" to "Lean Democrat." RCP ranks the following 8 seats as "toss ups:" CT, IN, MA, MT, ND, NV, VA and WI.
- NY Times (47 DEM- 46 GOP)- The only change in the NY Times rankings was the movement of Wisconsin back to toss-up from lean Republican. The NY Times identify Maine, Massachusetts, Missouri, Montana, Nevada, Virginia and Wisconsin.
Polling Watch: A lot of polling data released this week, the vast majority of it suggesting a movement in support for Congresswoman Tammy Baldwin (D-Madison) and an uptick in enthusiasm among those voters identifying themselves as Democrats and Democrats making up a greater amount of the electorate. In the survey summaries below, we note the differences in party identification (PID) in the sample of survey respondents. Baldwin Campaign (Feldman) Congresswoman Tammy Baldwin's campaign on Monday released a memo by their pollster The Feldman Group that had their candidate Representative Baldwin leading former Governor Tommy Thompson by 5 points, with Baldwin receiving 50% of the vote to Thompson's 45%. The memo stated that Thompson led Baldwin in their polling in August 50% for Thompson to 44% for Baldwin. In their methodology statement, Feldman noted that their sample was 34% Democratic, 28% Republican and 34% independent which they state "reflects statistical modeling of partisanship on the filed supplied." Democracy for America (Public Policy Polling) Democracy for America (DFA) is the liberal grassroots third-party organization founded and chaired by former Vermont Governor and presidential candidate Howard Dean. PPP highlights in their memo that Congresswoman Baldwin is running ahead of Pres. Obama in Wisconsin, with a 3 point lead over Thompson, to Obama's 1 point lead over Romney. Their memo also suggests that Baldwin has secured her base more than Thompson with Democrats favoring Baldwin over Thompson 84-11, and Republicans favoring Thompson 78-9, with Independents split 42 for Baldwin-41 for Thompson. The sample for this survey was 32% Democrat, 36% Republican and 32% Independent. Complete memo here.
YouGov YouGov, an online survey research firm founded by a Standford professor, found Thompson holding a 6-point lead over Baldwin. President Obama was leading former Governor Romney by 2 points. The YouGov sample was 37% Democratic, 31% Republican and 30% Independent. The compete memo is here.
Marquette University Law School: The Marquette University Law School survey, which made the most political noise last week, found Baldwin leading Thompson by 9%, an 18% swing since their survey one month earlier. Professor Charles Franklin noted that the survey could have had a bad sample, which had a +11% Democratic lean in party identification with leaners, however when re-weighted to average PID for the year, their survey had Baldwin up 5%, 48% to 43%. Quinnipiac/NYT/CBS- In their third look at Wisconsin, the Quinnipiac survey found that the Senate race in Wisconsin is now tied at 47% to 47%. The sample for this survey was 35% Democrat, 32% Independent and 27% Republican. In their previous survey in August, the poll had Gov. Thompson leading by 6 points, 50% Thompson to 44% for Baldwin, with a sample that was 32% Democrat, 39% Ind/other and 28% Republican. In their first survey, which was tied at 47%, the sample size was 34% Democrat, 27% Republican, 39% Indpendent/Other. Complete results can be found here.
Rasmussen: There have been wild swings in the Rasmussen poll over the last 3 months. In July, Rasmussen had Baldwin leading Thompson by 7 points, 48% to 41%. After the GOP Primary, Rasmussen noted that Thompson got a "bump" and climber to an 11 point lead over Baldwin at 54% to 43%. Now Rasmussen has Baldwin back in the lead by 3%, 49% to 46%. The sample PID for likely voters in this latest survey is 39% Republican, 36% Democrat and 25% Other. Complete information from Rasmussen is only available to subscribers here NBC/WSJ/Marist- In their inaugural look at the US Senate race in Wisconsin, the NBC/WSJ/Marist poll found that Congresswoman Baldwin had a 2 point advantage, leading Governor Thompson 48% to 46%. The Party ID breakdown of their sample was 33% Democratic, 28% Republican and 38% Independent. Complete results can be found here. PPP- In their second look at the US Senate race in a week, PPP found that Baldwin gained 1 point on Thompson, extending from a 3 point lead in their survey for DFA to a 4 point lead a week later. The PID for their sample was 34% Democratic, 31% Republican and 35% Independent. The complete PPP results can be found here. Pollster Trend: With the addition of all this polling data, the Huffington Post-Pollster trend for Wisconsin has moved slightly from a 1.2% lead for Baldwin, to a 2.0% lead. - Tammy Baldwin 48%

Last week we had the Vice President and the Republican nominee for Vice President in the state, this past week we had the Republican nominee's wife and son, Ann Romney in Wisconsin, followed by a visit from the President.

Similar to the US Senate race, a tremendous amount of data was released this week on the presidential race in Wisconsin, with polls varying from the race being essentially tied to President Obama having a 14 point lead. Post the Democratic Nation President Obama's current daily tracking job approval moved favorably with a 5% uptick in job approval and a 5% reduction in job disapproval.

The Electoral College (Race to 270): This week the electoral map got a little bluer according to battle ground state polling.
- RealClearPolitics.com current race projection The RCP projection changed this week with Wisconsin moving to lean Obama. Previously Wisconsin was in the lean Obama category, but moved to toss-up in early August.

Pollster has NC at 2% for Romney, down 2% from last week and RCP has NC at 1.8% for Romney, down 3% from last week.

Wisconsin voters believe that 12 is > than 4, but not quite 3x
A quick distraction on the lighter side. In the dump of all the public polling research data this week, there was one polling firm that truly captured what was on the minds of Wisconsin voters a couple weeks into September.

Analysis: #12 Aaron Rodgers has almost unanimous favorability amongst Wisconsin voters, but his favorability is almost, but not quite three times that of #4 Brett Favre. So 12 is greater than 4, but not quite three times.
