Legislature Has Busy Week Again Next Week

Next week, the legislature will be back in session after a busy week this past week where it was both in regular session and in special session to act on Governor Walker's request to go into special session in order to 'Get Wisconsin Back to Work.'

  

The Assembly will meet next Tuesday, October 25, in regular session and will consider the following bills:  

AJR-34. Pregnancy Centers (Jacque) Honors pregnancy care centers and proclaims  October 2011 as Pregnancy Care Month.

AJR-57. Richard Cates (Hulsey) Memorial - Richard Cates.

AJR-61. Gervase Hephner (A. Ott) Memorial - Former Democratic Rep. Gervase Hephner.

AJR-66. Pregnancy/Infant (Milroy) Pregnancy and Infant Loss Awareness Month.

AJR-67. Adoption (Kerkman) Recognizes November as Adoption Month.

AJR-68. Petersen (Petersen) Life and public service of Richard Petersen.

AB-63. Retail Liquor Sales (Wynn) Changes morning closing hours for Class "A" and "Class A" retailers from 8 a.m. to 6 a.m. so Class "A" retailers may sell beer from 6 a.m. until midnight, unless local ordinances are more restrictive.  "Class A" retailers would be able to sell liquor from 6 a.m. to 9 p.m.

AB-93. Tobacco Purchases (Bies) Prohibits purchase of tobacco products on behalf of, or to provide to, a minor.

AB-104. DNR Board (LeMahieu) Revises membership on DNR Board.

AB-125.  Trails Council (Kestell) Changes membership on State Trails Council.

AB-132. Motor Vehicle Dealers (Ballweg) Enumerates several additional actions of a manufacturer, importer or distributor with respect to a dealer as violations. 

AB-147. Health Care Providers (Severson) Inadmissibility of a statement of apology or condolence by a health care provider.  

AB-158. Conservation Congress (Mursau) Voting at meetings of the conservation congress.

AB-161. Fall Primary (Tauchen) Changes September primary from 2nd Tuesday in September to the 2nd Tuesday in August and renames it the Partisan Primary.

AB-164. Police Officer Injuries (Endsley) Soft tissue injury of a law enforcement officer when resisting or obstructing arrest.  

AB-200. County Fair Wine Sales (Bernier) Authorizes a winery to make retail sales and provide samples of wine on fairgrounds under the "Class B" license issued to the fair association.

AB-212. Public Safety Workers (Honadel) Prohibits throwing or expelling a bodily substance at a public safety worker. 

AB-217. Impersonating Certain Officials (Bies) Extends prohibition against impersonating a peace officer to fire fighters, EMTs or first responders.

AB-245. Prescription Drugs (J. Ott) Procurement of prescription drugs by a faculty member at an institution of higher education for the purpose of lawful research, teaching or testing.

AB-263. Police Costs (Knodl) Costs associated with providing false information to a law enforcement officer.

AB-265. Bicycles (Ripp) Definition of bicycle; manual turn signals for bicyclists; lighting of bicycles, motor bicycles and electric personal assistive mobile devices, overtaking and passing vehicles, operation of bicycles equipped with metal-studded tires; moped parking.  

AB-275. BCPL (Brooks) Makes various changes affecting the Board of Commissioners of Public Lands.  

AB-290. Wine Manufacture (Kooyenga) Expands coverage of wine and beer not for sale exemptions.

AB-300. License Plates (A. Ott) Changes affecting registration plates for dealers, distributors, manufacturers and transporters of motor vehicles.

AB-301. DNR Spending (Suder) Joint Finance Committee review of DNR spending of certain federal funds.

AB-302. Nursing Homes (Knodl) Makes various changes in regulation of nursing homes.

AB-305. Sealed Containers (Petrowski) Permits for overweight vehicles or combinations transporting sealed containers or vehicles in international trade.

AB-306. Agricultural Vehicles (Petrowski) Annual or consecutive month permits for certain overweight vehicles or vehicle combinations transporting agricultural products.  

AB-310. UC (Ballweg) Various changes in the unemployment insurance law.

 

Senate Proposals

SB-96. Motor Vehicle Dealers (Leibham) Enumerates several additional actions of a manufacturer, importer or distributor with respect to a dealer as violations.

SB-107. Landlords (Lasee) Prohibits ordinances limiting certain things a landlord may do.

SB-109. Police Officer Injuries (Leibham) Soft tissue injury of a law enforcement officer when resisting or obstructing arrest.

SB-116. September Primary (Lazich) Changes September primary from 2nd Tuesday in September to the 2nd Tuesday in August and renames it the Partisan Primary

The Senate will also meet next week, but as of this writing, Senate leadership has not released the floor schedule for next week.

 

State Agencies Face Lapses
This week, the Department of Administration (DOA) directed state agency heads to plan for spending lapses and transfers up to $300 million for the balance of the current 2011-13 biennium that expires on June 30, 2013. The plans are due in the State Budget Office by November 7.

 

In his memo to state agency heads, DOA Secretary Mike Huebsch said, "Given the economic uncertainty this biennium, it is prudent to plan for a larger lapse."

 

Also, this week, the Legislative Fiscal Bureau provided an update to lawmakers about the state's fiscal condition based on the state's Annual Fiscal Report for 2010-11, which was released last Friday. The report showed the 2010-11 General Fund balance at $85,567,000, which is $679,400 less than was projected when the current budget was enacted. Moreover, the 2011-13 General Fund condition shows a projected balance of $72,736,300 on June 30, 2013, or $7,736,300 after a required $65 million set aside for the statutory balance(www.thewheelerreport.com). 

 
2012 Election Happenings

This week, the Government Accountability Board (GAB) released a memo that stated that if recall elections are held next year against current incumbent lawmakers those elections will be held in the incumbent legislator's current district and not in districts for which candidates will seek election in November 2012 (www.thewheelerreport.com).

 

The ruling by the GAB clearly has political impacts because beginning in November 2012 all 99 Assembly members and half of the Senators will face re-election in districts that were created this past summer through Republican-led redistricting efforts. Republican leaders wanted the GAB to allow for any of its members facing recalls to be able to run in the newly-drawn districts, which are presumed to be much "safer" politically for current incumbent Republican lawmakers.

  

Recall petitions can be filed starting November 4 against all senators in odd-numbered districts and those in even-numbered districts who were not recalled in the August elections.  All members of the Assembly elected in November, 2010, could be the target of recalls.
