State Budget Passed

Democratic legislators from both the Senate and Assembly used their power to approve a budget that closed the remaining $10 billion deficit with a simple majority vote. The broad outline of the deal is outlined below from a report contained in the Sacramento Bee.

Budget Done, But Counties' Work Not Finished

Governor Jerry Brown signed the 2011-12 state budget yesterday without much fanfare, using his blue pencil to veto a total of $270 million from the state budget, $23.8 million of which is from the General Fund. The Governor has not yet acted on all trailer bills, but we anticipate him doing so in short order. So, the question of the day is: what next?

Implementation of SB 1355 Underway

The Department of Child Support Services (DCSS) has made it a priority to consult with Local Child Support Agencies (LCSAs) and courts on the interpretation and implementation of Senate Bill 1355 (Chapter 495, Statutes of 2010) which added Section 4007.5 to the Family Code (FC) and is effective July 1, 2011.

National Incentive Workgroup Moves Dialogue Forward

Highlights of CA IV-D Director's Response to Federal Incentive Survey

On May 31, 2011, Interim Director Kathleen Hrepich responded to a federal survey of State IV-D Directors about the performance incentive system.  The input will be used by OCSE Commissioner Turetsky and the Federal Incentive Workgroup to consider changes to the current system. 

 

Federal incentives are very important to California.  The State earned over $37 million in Federal Fiscal Year 2009 from this source.  The funds are reinvested directly into the child support program to offset the cost of local operations.

Los Angeles County Board Recognizes CSSD FIDM Project Team

The Los Angeles County Board of Supervisors regularly recognizes employees for exceptional performance through a program called LA COUNTY STARS (Special Talents for Achieving Remarkable Service). On June 21st, the Board recognized the Child Support Services Department's Call Center Financial Institution Data Match Project Teams as the newest STARS honorees in the category of "Service Excellence and Organizational Effectiveness".

Outreach Using QR Codes

Quick Response (QR) codes are two-dimensional barcodes. Using your smartphone with a QR Code reader, you take a picture of the QR Code. The QR Code can display text, take you to a web page, or play a video. The QR Code reader may also give you an option to save the link on your smartphone for later.

Work Continues to Determine Benefit and Value of Child Support Services to CalWORKS Recipients

Work continues on the IV-D/IV-A research project that was outlined in the Spring 2011 edition. The focus of the project is to affirm the benefit and value of child support services to the recipients of CalWORKS. One of the most important steps in the analysis, the validation of the data, has been completed.

Turner v. Rodgers Supreme Court Decision
Published by the National Child Support Enforcement Association (NCSEA), July 1, 2011

The Supreme Court has issued a decision in Turner v. Rogers, a case that NCSEA has been watching closely. Among the issues addressed was whether a state must provide indigent defendants with counsel in all child support contempt proceedings where the defendant is facing incarceration.

SDU Transition Team Publishing Information to Inform LCSA Staff

It's nice on a project like the SDU Transition to be able to report that things are just moving along. Lots of meetings, lots of detailed planning (down to the minute in some instances), but no large risks have been identified at this juncture. The transition is still slated for December 2-5, 2011 with ACS, Bank of America, DCSS and the LCSAs engaged in a lot of activities between now and then.

My Experience at the 2011 CSDA Child Support Attorney College

As a new child support attorney I was delighted to have the opportunity to attend the CSDA 2011 Child Support Attorney College in beautiful Santa Rosa. First of all, the setting for the conference was in one of the most beautiful areas of Northern California. This lovely location was the foundation for a very relaxing, yet informative experience. As a relatively new child support attorney, I reaped many benefits from my attendance at this event.

Legal Practices Committee Update

Policy and Regulations Committee Update

With the welcoming of summer and the suns warmth (finally!), the Policy and Regulations Committee held its June 2011 meeting with a focus on child support program hot topics!

 

First up to bat was dialogue on the implementation of California Senate Bill (SB) 1355. Child Support Services (CSS) Letter 11-08 was recently released providing statewide policy on the new Family Code Section which allows for suspension of child support if an obligor (paying parent) is incarcerated or institutionalized for any period over 90 consecutive days. Suspension language has been adopted and embedded within applicable Judicial Council forms however CSE system legal forms have not yet been updated with the new language.

Video Production/Incarcerated Obligor Workgroup Update

There's exciting news in the Incarcerated Obligor and Video Production workgroups. CSDA Deputy Director Natalie Dillon and Marin County DCSS Director Keith Pepper met with high ranking officials at the Department of Corrections and Rehabilitation (CDCR) this week in an effort to secure interest and support for the women's version of the "What You Need to Know- Child Support Rights and Responsibilities" video and a reentry video aimed at educating the "soon to be released" on their responsibilities to reconnect with the child support program.

Attorney Faculty Committee Update

With budget concerns, travel restrictions, court schedules and the like, many child support attorneys do not have the opportunity to attend the annual Child Support Attorney College sponsored by the California Child Support Directors Association, thus missing out on an excellent opportunity to learn and earn MCLE.  Recognizing these challenges and yet committed to providing top-notch legal training to all California child support attorneys, the CSDA Attorney Faculty Committee is working on providing new and exciting training using technology readily available on our computers through the internet.
