Raise Your Hand If You Want To Get Sued  By Mike Ware, EPCMS Executive Vice-President It's not often I see something that makes me smack my forehead and say "What are you thinking!?!" Well, if you were with me last Thursday you saw it firsthand. Forty-nine out of fifty states protect peer review records from trial lawyer fishing expeditions. Right now, Colorado is one of them, but if the trial lawyers have their way that will change. Every seven years Colorado's regulations must be reauthorized, and this year, peer review protections are on the list. If passed, HB 1300 will guarantee that the current peer review protections stay in place. If it is not passed, trial lawyers will be able to start using your peer review records in court starting on July 1, 2013. Sadly, this isn't what made me smack my forehead. Who doesn't expect trial lawyers to want new ways to sue? I smacked my forehead because the Colorado Senate is thinking about going along with this. It doesn't make sense. First, these reforms offer a common sense and balanced approach to holding physicians accountable in a way that improves patient care. Second, these patient-centered policies offer physicians peace of mind that they can critically evaluate their care in a nonjudgmental environment, and patients the peace of mind in knowing that their physician is constantly focused on improving. Finally, protecting peer review documents from legal discovery has created a culture of care improvement. Physicians are free to discuss improving patient care without fear that these discussions will be used against them. Imagine if the opposite were true.... Physicians could be sued for discussing ways to improve a process. Physicians could be sued for asking "how could I have done this better." Physicians could be sued for saying "I'm human. Help me learn from this experience." There's a reason almost every state in our country protects peer review documents; because peer reviews work. They improve patient care, and we must protect them.
HB 1300 must pass the legislature by May 9, 2012. Will you call Senator John Morse (D-Colorado Springs ) today at 303.866.6364 and ask him to pass HB 1300, the peer review authorization bill?

New Regional Health Care Behemouth Called University of Colorado Health
Check-Up: Memorial Health System
The University of Colorado Hospital and the Poudre Valley Health System are merging to create University of Colorado Health. The agreement, which has been approved by both existing systems and their partners, would establish a governing board of eleven directors and an executive team to guide the new organization. University of Colorado Health is currently negotiating with Colorado Springs city officials to lease and operate the city's Memorial Hospital. The arrangement would require approval by Colorado Springs voters.
University of Colorado Health, a regional non-profit, is proposing to bring Memorial into this new partnership in their RFP to Colorado Springs City Council: an up-front $74 million lease payment, a $5.6 million annual payment for forty years, a $1.12 billion capital commitment over the life of the lease, plus a commitment of $3 million a year towards establishing a branch campus of the University of Colorado School of Medicine at the University of Colorado at Colorado Springs. Also, UCH is offering a profit-sharing plan in which the city would get five percent of any profits above eight percent. UCH says it would investigate other ways to deal with Memorial's pension liability, including allowing some employees to remain in the state's Public Employees' Retirement Association.
Bruce Schroffel, president and chief executive of University of Colorado Hospital, was named president of University of Colorado Health as well as chairman of the board of directors, and Rulon Stacey, president and chief executive of Poudre Valley Health System, will serve as CEO of University of Colorado Health.
